| Since the implementation of reform and open policy, with the high speed development of China's economic construction, public environmental degradation is becoming faster and faster, the pressure on government to protect the environment is increasing. In view of the unique public character of environmental elements, to effectively manage the social environment-a social product, it requires not only administrative departments of the government to manage actively and properly, but depends more on the participation of the whole society. In the early 1970s, the international community admitted the "environmental public participation principle" in many global conferences, our country also made legislative confirmation for this principle, Environmental Protection Law stipulates that each citizen enjoys the rights to protect the environment and to participate in the environmental management. But from the work practice, as well as the news media frequent reports, the author feels that the effects of public participation in environmental impact assessment has not been implemented, the wish of public participation in environmental management failed, and this directly causes our country environment deterioration failed to be curbed, the environmental management remains difficult. And trace the root to its source, it is due to China's legislation of public participation in environmental impact assessment is too simple, without uniform standard.With that in mind, the author interprets the concept, basic theory and the legislative process of public participation in environmental impact assessment, and takes three typical case for reference, to analyze the current situation of the public participation in environmental impact assessment, and on this basis to explore how to improve public participation in EIA.
