The shortage of water resources and unreasonable utilization of water resources are prominent in Ningxia.How to strengthen the protection of water resources is a major issue facing Ningxia in the construction of ecological protection and high-quality development pioneer areas in the Yellow River basin.The implementation of water right transaction is of great significance to the efficient utilization and optimization of water resources allocation.Ningxia has been actively promoting water rights trading for a long time and has rich practical experience in water rights trading,but the overall marketization level of water rights trading is still low.It is of great practical significance to explore the problems existing in water rights trading in Ningxia from the system for improving the marketization level of water rights trading and better realizing the optimal allocation of water resources.First of all,the concepts of water right,water right,water right and water right transaction are defined,the legal attribute of water right transaction is clarified,and the theoretical basis of water right transaction is explained,which can establish a scientific and feasible theoretical basis for the water right transaction system in Ningxia.Secondly,we systematically sort out the relevant institutional systems in China,including laws,administrative regulations,departmental rules and other national legal systems,as well as local systems such as normative documents promulgated by Ningxia,thus forming a more systematic and complete system of water rights trading system from top to bottom.The practice of water right transaction in Ningxia is the concrete implementation of the legal system of water right transaction in Ningxia.Thirdly,the problems of water right trading system in Ningxia are explained in detail,such as the operation system of water right trading and the supervision system of water right trading,in particular,the operation system of the transaction period is not clear,the transaction mode is single,trading platform is restricted in the development of water rights trading market in Ningxia,however,the lack of supervision on illegal water use and the vague auditing standard of water right transaction affect the effective operation of water right transaction.Finally,in view of the above-mentioned problems,we should establish a systematic and complete operation system of water rights trading,and introduce more market elements into the trading elements such as trading period,trading method,trading price and trading platform,etc.,to further enhance the level of marketization of water rights trading,and through strict implementation of total control of water rights,water licensing system,the establishment of a sound reward and compensation mechanism,monitoring mechanism and legal responsibility system,such as water rights trading regulatory system,we will continue to promote the rule of law in water rights trading.Through the market-oriented,legal system reform will be able to further play the role of water rights trading to optimize the allocation of water resources,water conservation and use of water resources,make the water right exchange market form a stable,sustainable,efficient operation of the long-term mechanism.
