As a vulnerable group in the society,the cultural rights of people with mental disabilities are generally ignored,but they have the legitimacy and possibility to enjoy cultural rights.In terms of legality,from UN conventions and declarations to China’s policy documents,it is emphasized that people with disabilities should equally enjoy various civil rights including human rights.China’s policy documents related to cultural development also clearly point out that equal access to public cultural service systems should be promoted to guarantee the cultural rights of vulnerable groups.In terms of possibility,there was a discussion about the relationship between "creativity" and "nervousness" as early as the ancient Greek period.From ancient times to the present,there is no shortage of art masters who have suffered from mental illness but have achieved outstanding artistic achievements.The emergence of Art Brut has shown the possibility of more people with mental disabilities to enjoy cultural rights to the public.The development and research of art therapy in the treatment of modern mental disorders has also further enhanced the possibility of people with mental disabilities to enjoy cultural rights.However,in real life,because of their limited personal ability and social resources,it is difficult for them to truly enjoy cultural rights.The government’s efforts in promoting and implementing the equalization of public cultural services cover more vulnerable groups such as rural residents,the elderly,migrant workers and physically disabled,which are "non-social unstable factors",thus losing their place in the practice of guaranteeing the cultural rights of people with mental disabilities.Only a few public welfare organizations provide cultural services to people with mental disabilities and protect their cultural rights.This paper takes WABC,a representative organization of this kind,as a case,introduces and analyzes the four operation modes of WABC,a grassroots public welfare organization that is self-financing,adopting "independent fundraising","enterprise cooperation","public welfare organization cooperation" and "government cooperation" in the process of protecting the cultural rights of people with intellectual disabilities.Various services are provided to people with mental disabilities to implement the protection of their four aspects of cultural rights.Finally,it has positive significance in enabling people with mental disabilities to enjoy their cultural rights,promoting their rehabilitation,making up for the absence of government,and enriching the supply of public cultural products.However,although public welfare organizations such as WABC have achieved some success in protecting the cultural rights of people with intellectual disabilities,there are still some problems in relying solely on public welfare organizations to protect the cultural rights of people with intellectual disabilities.From the perspective of the WABC organization selected in this paper,there are some problems in its service supply,such as unclear organization positioning,insufficient fund-raising capacity and insufficient manpower input,which will affect the continuity and high quality of its service supply.Therefore,the organization can clarify its positioning by clarifying the service core and service field of the organization.Improve fundraising capacity by improving its own income generating capacity and expanding external fundraising channels;And in the teaching work and operation work to increase human input to attract high-quality talents and other measures to solve the existing problems,improve the quality of their own service supply,better protect the cultural rights of the disabled people.And from the whole environment of our public welfare organization operation,just rely on the public organization to protect the rights of essence of disabled people to enjoy culture and there is a public welfare organization overall lack of normative operation,government support and dominate the lack of pertinence,public participation and support such problems as lack of enthusiasm,can strengthen the regulation of the government,society and organization in order to improve the standardization of public welfare organization operation;By improving the pertinence and inclination of policy support and the diversity of support means to improve the government support intensity;By improving the public’s understanding of people with disabilities and their trust in public welfare organizations,the initiative of public participation will be enhanced.
