A Study On The Reform Of Statutory Board In China’s FreeTrade Zone

At present,China is in the deepening period of reform and opening up.As the highland of reform and opening up,the free trade zone undertook the important mission of pilot,reform and innovation at the very beginning of its establishment,and it needs to innovate the government governance model to inject vitality into the development of free trade zone.In practice,a number of free trade zones in China have set up statutory boards to undertake administrative management and public service functions originally belonging to the government,so as to transform government functions and innovate government governance models.The reform of statutory boards has become an important way for the reform of administrative management system and the innovation of government governance mode in the free trade zone.Therefore,this paper focuses on the reform of the statutory boards in the governance of the free trade zone,and tries to present the realistic prospect of the reform of the management system of the free trade zone and the transformation of government functions through the carping of the management system of the free trade zone in China and the analysis of typical cases of the reform of statutory boards.This research is divided into six parts:The first part is the introduction,which introduces background and significance of the study,sorts out the research status at home and abroad,clarifies the core concepts,introduces the theoretical basis of this research---entrepreneur government theory and principal-agent theory,and clarifies the research ideas and methods and the possible innovation points of this paper.The second part is about the basic aspects of the government administration and the establishment of legal institutions in China’s free trade zones.It summarizes the overall framework of the government administration in China’s free trade zones,and introduces the distribution,establishment and responsibilities of the statutory boards in China’s free trade zones.The third part is the typical case analysis of the reform of the statutory boards in China’s free trade zone.With the framework of"Scenario-Goal-Strategy",the cases of the reform of statutory boards in two free trade zones,Qianhai Shekou Free Trade Zone in Guangdong Province and Lujiazui Financial Free Trade Zone in Shanghai Province,are selected for analysis.The fourth part is the experience and inadequacy of the reform of statutory boards in China’s free trade zone.Based on the principal-agent theory,the case comparison is conducted,and the experience and inadequacy are summarized through case comparison.The fifth part is the experience of the operation mode of the statutory boards of Singapore Free Trade Zone.By benchmarking the international advanced level,it provides support for the follow-up countermeasures and suggestions.The sixth part is the suggestions on deepening the reform of the statutory board in China’s free trade zone.Through the comparison of two typical cases of the reform of statutory board in the free trade zone,this paper finds that the two typical cases respectively show different principal-agent arrangements.Among them,Qianhai Shekou Free Trade Zone shows the principal-agent arrangement of "government administration and enterprise integration",which combines government management authority and enterprise operation,Lujiazui Financial Free Trade Zone shows the principal-agent arrangement of "separation of government from enterprise",which combines the cultivation of decentralization by the government and network operation.At the same time,this paper summarizes the practical.experience of the reform of the statutory boards in the free trade zone in innovating the management system,transforming the government functions,improving the government governance ability,and reshaping the boundary of public management,and analyzes the problems existing in the reform,such as the unclear boundary of power and responsibility,the lack of legal protection,the problem of de-administration,and the regulatory risks.According to the above problem,can make clear from the right boundary between the government and statutory boards,strengthening the legal and institutional function,advance to the administrative agencies into legal reform can assign,effective regulation under the"proper distance control" four aspects,further deepen the reform of statutory board in China’s free trade zones and modernize the government’s governance system and capacity.
