Research On The Accountability System For Major Administrative Decisions

The development of the rule of law in administrative procedures has a long history in our country,but the number of procedural normative documents formed is few.The introduction of the Provisional Regulations on Major Administrative Decision-Making Procedures has enriched the administrative procedural documents of our country,but because of its low legislative rank and thin content,it is not enough to make effective adjustments to the accountability system of major administrative decision-making.Through the progressive mode of administrative procedure,administrative decision-making procedure and major administrative decision-making procedure,this paper introduces the connotation and scope of major administrative decision-making,the type of responsibility of major administrative decision-making,the principle of accountability and the constituent elements.Moreover,in the second part,through reviewing the legislative process of the system,it mainly introduces the stage process from theoretical research to the introduction of policy documents,from local legislation to central government legislation.In this process,it is necessary to continuously upgrade the level of legislation,from local legislation to the national people’s congress legislation,for the adjustment of major administrative decisions to provide the most powerful legal protection.The third part of the author tries to start from the accountability subject single,the lack of accountability procedures,accountability supervision mechanism is not perfect several parts to start,to find out the major administrative decision-making accountability system pain point.The single subject of accountability will lead directly to the monopoly of accountability power in the hands of a few people,which is not conducive to the punishment and protection of the subject of responsibility.The lack of accountability procedures will lead to a lack of procedural justice for accountability and the failure to achieve the organic unity of entities and procedures.The supervision mechanism is not perfect,and can not be effectively supervised in the whole process of accountability.The fourth part of the author according to the insufficient part of one by one put forward possible solutions or legislative design,including the establishment of a diversified accountability mechanism,the establishment of a complete accountability procedure mechanism and supervision mechanism,especially to give full play to the advantages of the National People’s Congress,strengthen the construction of information disclosure system.
