Research On Accountability System Of Major Administrative Decisions

National legislation builds a barrier to defend and punish decision-making mistakes by constructing and perfecting the responsibility investigation system of major administrative decisions.The implementation of the Interim Regulations on Major Administrative Decision-making Procedures in 2019 has made it clear that governments at all levels must strictly abide by the legal norms governing major administrative decision-making procedures.In 2021,the Implementation Outline for the Construction of A Government under the Rule of Law（2021-2025）marked a new milestone in the construction of a government under the rule of law in China,with the emphasis on strictly preventing risks of major administrative decision-making and decision implementation,and carrying out accountability.At present,due to the lack of centralized and special legislation at the national level,the existing system provisions are scattered,theoretical exploration mostly stays at the macro level,local provisions differ greatly,and the degree of standardization is not high,so the value goal of the system has not been better realized.This article adopts the method of literature research and empirical analysis,combing the actuality of local legislation,theory and the reference to the research and analysis of typical cases and summarize the major administrative decision-making in our country at present the responsibility system has the responsibility scope of implementation of a single,responsibility subject uncertainty,responsibility shall be investigated for the deficiency in the application,problems such as lack of effective supervision responsibility,Put forward suggestions for improvement.It includes establishing a multi-subject accountability system from two aspects of standardizing the same subject and perfecting the different subject,so as to realize the authority and standardization of responsibility accountability.According to the power and responsibility of the different participants in the decision-making procedure,we can accurately identify the object of liability investigation.Perfect the accountability procedure from the three aspects of the initiation,investigation and decision of the accountability procedure to ensure the fairness and justice of the accountability results;From perfecting the supervision mechanism,strengthening the supervision after the event,further strengthen the responsibility of major administrative decisions tracking supervision system.
