Study On The Problems And Countermeasures About System Of Community Correction In China

In December 2019," Community Correction Law" was promulgated to provide clear legal compliance for the development of China ’ s community correction work,marking China’ s work into a true sense of the Rule of law era.In 2003,China’ s community correction began to start,has been fully implemented for many years.The community correction system conforms to the criminal policy of " Temper justice with mercy" and the ruling idea of" Harmonious society" in China.However,the community correction system is mainly transplanted from the Western countries,and there are great differences between China’s institution and the Western countries.In practice,some specific systems do not conform to China’s judicial practice,need to be revised and improved.Based on the practice of community correction in W city,this paper discusses the problems in the process of community correction,analyzes the reasons behind and puts forward the countermeasures.In the introduction part,the background of this paper is briefly introduced,including the related issues of community correction research at home and abroad,research significance and methods,etc..IIn the second part of this article,mainly discusses the basic connotation and the concrete characteristic of the community correction,and unifies our country community correction the development course,elaborated the Community Correction Practice Foundation,thus seeks this system to have the actual value and the related theory supportIn the third part of this paper,through taking the community correction in W city as the research sample,the author analyzes the problems in the practice of the community correction system,pointing out that there are some practical difficulties in the current work,such as the low rate of parole in community correction objects,the limited role of pre-trial investigation and evaluation,the poor connection between relevant departments,the insufficiency of rewards and punishments in community correction,and the formalization of educational support,further analysis of the causes of the above difficulties lies in China’s current low level of social support for community correction,related laws and systems are not perfect,community correction funds are insufficient,community correction institutions set up and personnel unreasonable.At the same time,the advanced experiences and practices of Beijing and Shanghai are summarized and summarized to provide reference for w city.In the fourth part of this paper,based on the development of community correction in w city,we draw on the experience of Beijing and Shanghai to improve the current community correction.First of all,improve the social basis of community correction.Including changing the national concept to improve the understanding and identification of community correction work,optimize the construction of new community,enhance the public as volunteers to participate in the work of enthusiasm.Secondly,improve the relevant supporting system of community correction.Specifically,including:Improve the parole system;strengthen the pre-trial investigation and evaluation system;establish and improve the judicial executive branch and public,procuratorial,legal and other departments of the convergence mechanism;improve the community correction reward and punishment system,increase rewards and punishment measures;improve funding security mechanism;We will improve the mechanism for supporting education.Finally,in the strengthening of institutions and team-building,straighten out the establishment of community correction institutions,enhance the staff’s ability and quality.
