Research On Community Correction Penalty Execution System In Our Country

The criminal law exists to maintain social order, stability and harmony, and itsfunction is to deter crimes rather than retaliate and eradicate crimes. Brutal executionsof punishment will never be a rational choice that a civilized society would make.With the progress of human civilization and economic development, the concept ofpenalty is displaying Moderating Trend. Therefore most countries are carrying outreforms and innovations of the execution of punishment. Under the guidance of theprinciple of human rights respect and protection, to the perpetrator, most humane andeffective penalty approach should be chose. The Community Correction emerges inthis background.Community correction is a manifestation of the individual and social penalty, andalso the concrete implementation of respects and protects for human rights of the statein the penalty field. In July2003, the Supreme People’s Court and the SupremePeople’s Procurator ate, the Ministry of public security, the Ministry of Justice jointlyissued the "notice" on the experimental work of the Community Correction, whichopened a new era of community correction in China. After nearly a decade ofexperimental work, Community Correction has achieved tremendous results, butcompared with relatively complete foreign community correction system China’scommunity correction work is still in its infancy, the scope of improper correction ofinexperience, the lack of specialized correction team, supporting operating system notperfect and so endless are all problems should be solved.To solve these problems，we must focus on China’s national conditions and socialbackground, deeply study the theoretical basis of the Community Correction, clear thepractical value of the community correction, objectively view the problems existed inthe practice of China’s community correction，be away from shyness or contempt，atthe same time, we should draw lessons from foreign communities in legislation systemsand measures, professional training experience to develop and build a special law of the Community Correction and Community Correction implementation systemsuitable for China.
