In recent years,Chinese student bullying have shown a high-incidence trend,and with the advantage of Internet platform,it has aroused so much attention in the whole society,but also caused social anxiety to a certain extent.Although through the joint efforts of many experts and scholars,the academic research on this social problem has gradually deepening,and the practical activities to prevent and control student bullying have also been continuing.But the deal with student bullying must be placed in the rule of law route to get the most accurate answers.Based on the current situation and the latest legislation of Chinese student bullying,this thesis trying to explores and optimizes the law rule route of student bullying in China.For a long time,China’s academic circles have not formed a unanimous definition of such harmful behavior among peer student groups,and it also lack of clear identification standards.The terms such as "School Violence","School Bullying" and "Student Bullying" are usually confusedly used.This ambiguity in definition directly constrains the relevant social practice.In December 2020,student bullying had been officially defined by the newly revised Juvenile Protection Law,it has become a law concept.Based on that,clarifying the meaning of student bullying and analyzing its elements and harmfulness become most important before whole research.This thesis analyzes the current situation about the rule of law of student bullying in China.Since 2020,a series of newly revised and legislated national laws have made special provisions on student bullying.It can be said that Chinese student bullying has entered a new stage of rule of law,and a comprehensive law rule system has been formed.Of course,the process of rule of law cannot be achieved overnight.Through the combing,induction and summary of the two levels of general legislation and special legislation,there are still some deficiencies.The main problems are lacking of systematicness under decentralized legislation model,unclear identification of bullying facts,unspecified measures,and lacking of attention to social strength.Therefore,we must optimize the rule of law comprehensive system.On the basis of analyzing the student bullying situation in Norway,the United States and Japan,learning their practical experience in dealing with student bullying,there are some special optimization plans for the comprehensive system of student bullying rule of law in China:Make special legislative activities in central and local dimensions for student bullying;Improve the discovery and reporting procedures of students’ bullying and clarify the identfication standards of student bullying;Detailed the contents of special education special school system and peer mediation measures;Pay attention to the cultivation of social awareness against student bullying,pay attention to the control and guidance of public opinion,and promote more research on student bullying.
