| The emergence of "COVID-19" virus is undoubtedly a cruel test for the international community.International health governance is facing heavy pressure,and the international economic and trade system has suffered a huge blow.In the name of epidemic prevention and control,various countries have adopted various temporary trade restrictions,and the risk of international trade disputes has increased.This can’t help but lead to further thinking about the compliance of temporary trade restrictions in the context of public health emergencies.The World Health Organization has declared the occurrence of "public health emergencies of international concern" for six times.By analyzing the SARS epidemic and the temporary trade restriction measures in previous public health emergencies of international concern,it is not difficult to find that international trade in services and international trade in goods are affected to varying degrees,except for the direct threat to human and animal and plant health.In the short term,the impact of international trade has caused serious economic obstacles to the governance of public health emergencies;In the long run,the Sino-US trade situation is still tense,and the development of the international trade situation is uncertain.Blindly adopting trade restriction measures is not conducive to the stability of the international trade order,nor to the benign advancement of globalization.Therefore,under the special background of public health emergencies,it is quite necessary to implement temporary trade restrictions,but it is equally important to maintain the development of international trade and economy.In this case,it is necessary that the temporary trade restrictions adopted by various countries conform to the rules of international law.International Health Regulations(2005)is an important governance rule for public health emergencies,and the international rules under the World Trade Organization are important standards for regulating international trade measures.Therefore,corresponding compliance analysis should be made from two aspects.This paper analyzes the compliance of temporary trade restrictions adopted by countries in public health emergencies from the perspective of taking into account the prevention and control of public health emergencies and the development of international trade,and objectively evaluates the serious damages caused by previous public health emergencies.Including the statistical data of direct or indirect international trade losses caused by temporary trade restriction measures taken by various countries,the analysis of the corresponding International Health Regulations(2005)and the relevant regulations under the World Trade Organization,and the detailed analysis and discussion of the compliance of temporary trade restriction measures taken by various countries under public health emergencies.With the aim of coordinating the management of public health emergencies with the development of international trade,this paper puts forward corresponding suggestions from the international level,and calls on China to actively respond as a big country and participate in global governance from the perspective of China. |
