Research On Administrative Regulation Of Webcast Platform

Network broadcast is a new industry in the Internet era in China.Since its emergence in 2016,network broadcast platforms have developed rapidly and attracted a large number of network users,enriching the entertainment life of the public.But at the same time,a variety of online live broadcasting disorder also occurs frequently,pornography,vulgar and vulgar,infringement and other live broadcasting content is repeatedly banned.The direct reason for frequent chaos in the network broadcast industry lies in the fact that the network broadcast platforms fail to fulfill their own obligations in pursuit of interests,and the reason why the network broadcast platforms fail to do so is mainly because there are unreasonable regulations on them.This paper takes the administrative regulation of network broadcast platform as the topic to explore how to make more feasible and effective regulation.The first part of the paper defines the two core concepts of network broadcast platform and administrative regulation.This paper clarifies the concept of network broadcast platform and summarizes the types of network broadcast platform in China,and summarizes the characteristics of network broadcast platform with strong real-time and interactive content,wide audience range,low cost and high income.At the same time,the regulatory subject,regulatory object and regulatory content of the administrative regulations of the network live broadcasting platform are framed,and the relationship between the network live broadcasting platform and administrative regulations is sorted out.The second part analyzes the current situation of the administrative regulation of China’s webcast platform.From the legislative level,China’s current laws and regulations in this field are mainly departmental rules and normative documents;From a practical perspective,in order to solve the dilemma of multi head supervision of administrative regulation in this field,China has successively established a special joint group and taken a series of special rectification actions.At the same time,it summarizes the problems existing in China’s administrative regulation in this field,such as incomplete legal norm system,overlapping functions and powers of regulation subjects,rigid means of administrative regulation,insufficient participation of industry subjects,and the supervision and accountability mechanism of administrative regulation need to be improved.The third part analyzes and summarizes the regulation measures of four typical countries,South Korea,the United States,the United Kingdom and Germany,and summarizes the experience beneficial to China on the basis of them.The fourth part is the suggestions to improve the administrative regulation of China’s webcast platform.The first is to improve the relevant laws and regulations system and refine the specific system content;The second is to optimize the functions of administrative regulation subjects and strengthen the coordination and cooperation of various regulation subjects;The third is to optimize the means of administrative regulation,such as introducing technical measures,strengthening in-process supervision,strengthening punishment,and using incentive measures;The fourth is to explore the collaborative regulation mode of industry subjects and strengthen the role of industry organizations in regulation;The last is to improve the supervision and accountability mechanism of administrative regulation.
