| As a special kind of existence in our country,colleges and universities have both civil and administrative features,and belong to "public legal persons." As an important part of the school,college teachers have two attributes of "public" and "private" due to the special nature of their work.They are special workers.Therefore,the personnel relationship between public universities and teachers is a special labor relationship.The personnel disputes between universities and university teachers are mainly manifested in the conflicts between university teachers’ autonomy,teachers’ labor rights and public interests.The involvement with public interests and the association with academic freedom make the handling of personnel disputes in colleges and universities more complicated than general labor disputes.Since the introduction of the employment system in colleges and universities,our country’s college teacher personnel reform has entered a new stage.At the same time as college teacher personnel reform,personnel disputes between colleges and teachers have gradually increased.Except for the internal relief of college teachers through colleges and universities,there are two ways to resolve the personnel disputes of college teachers in my country,both administrative and civil,but both of them have certain deficiencies.The main manifestations are rigid provisions,limited acceptance scope,unclear acceptance agencies,and lack of procedural regulations.By referring to the personnel dispute resolution mechanism of foreign universities and combining with the current situation of our country,the improvement of the personnel dispute resolution mechanism of college teachers should be carried out from the three aspects of internal relief,administrative relief and civil relief in universities.The specific regulations should be refined;the procedural guarantee should be improved.Realize the effective settlement of university teachers’ personnel disputes and effectively guarantee the rights of university teacher. |
