Legal Operation In Rural People's Mediatio

People’s mediation in rural society is a practical activity with rich legal research significance.People’s mediation is not only a spontaneous way of dispute resolution born in rural society,but also an institutional arrangement of national governance mechanism in grassroots governance.Under the background of the continuous promotion of the rule of law,people’s mediation has been given the mechanism characteristics in the sense of the rule of law,and mediation activities have gradually appeared in the language and appearance that meet the legal requirements.Through the practical investigation of the first line of the people’s mediation,under the historical deposition of traditional legal culture and the shaping of rich three-dimensional rural social environment,the rural people’s mediation shows the expectation of law adaptation strategy which is different from the national judicial organs.Moreover,because of the structural reasons of rural society and the practical difficulties of mediation mechanism,people’s mediation must respond to the new requirements brought by the background of the rule of law in the process of the development of rule of law,and effectively improve the effectiveness of dispute resolution.The foothold of the research on the legal operation of rural social mediation mainly lies in the investigation of the application of law in people’s mediation and the thinking of the legal development of mediation.The structure and writing ideas of this study is mainly through the investigation and interview of people’s mediation and village mediation activities in N town of eastern Henan,using field investigation,subject interview and data research methods,to show the historical development,specific types and new development characteristics of rural mediation.On the premise of in-depth description of mediation activities,this paper attempts to explore the role of legal rules in mediation activities and the strategies for the application of laws in mediation.Finally,it points out the dilemma of the application of laws in mediation mechanism and its causes.After sorting out the core issues in the development of the rule of law in mediation,it puts forward the breakthrough and direction of rural people’s mediation under the background and strategic layout of the rule of law construction and rural revitalization.Therefore,this study is problem-oriented empirical research.
