Corporate social responsibility(CSR)is a new international topic that has developed within economic globalization.Private regulatory standards set by non-state actors such as multinational enterprises,industry associations,NGOs and international intergovernmental organizations constitute the international soft law regulatory framework for CSR governance.However,the nature of soft law and the motivation of enterprises to voluntarily comply with soft law and other external influences have prevented the positive effect of soft law from being fully realized,and enterprises still violate CSR principles in their business activities.To solve the dilemma of CSR soft law regulation,Western governments have intervened and participated in CSR governance through various paths in order to improve the legitimacy and achievability of traditional soft law.This paper refers to how the paths of Western governments to strengthen the process of soft law as the mechanisms of action,specifically the mechanisms of normative response,process monitoring,and incentive implementation,respectively.The combination of these mechanisms and specific paths can strengthen the soft law norms of CSR and fully stimulate the motivation and willingness of enterprises to comply with these soft law norms,and ultimately promote the realization of CSR.It examines CSR from the perspective of government governance,and attempts to explore the potential role of the paths adopted by Western governments in addressing the limitations of soft law based on the intersection of international and domestic law.It firstly compares the soft law norms related to CSR and analyzes the reasons why their positive effects have not been brought into full play,and then points out the need for governments to play a greater role in CSR governance;on this basis,it continues to focus on the paths and mechanisms of the Western governments to promote the realization of CSR,analyzes and summarizes how they improve the soft law norms of CSR,so as to guide all parties to promote CSR more legally and effectively in a positive direction.This is consistent with the current trend of increasing government involvement in CSR governance in the international arena,and provides an important perspective for us to re-examine the development of CSR. |
