Research On Legal Regulation Of Local Government’s Breach Of Contract In Investment Promotion Contract

Local governments’ investment attraction is an important economic activity in various regions.Since the reform and opening up,local governments have constantly summarized the practical experience of investment attraction and achieved remarkable results in investment attraction,which has promoted the development of local economy.For a long time,it is common for local governments to default in the process of attracting investment due to planning adjustment,leadership change,policy change and other reasons,resulting in the smooth implementation of investment projects,which will not only damage the image of local governments,but also hinder the development of regional economy.Only when the local government strictly performs the investment promotion contract,provides high-quality public services for investors and creates a good investment environment can the investment promotion projects be implemented smoothly and the local economy achieve rapid development.Therefore,it is particularly important to study the local government’s breach of contract in the investment promotion contract,correctly regulate the government’s behavior and prevent the breach of contract.This paper takes the investment promotion behavior of local governments as the research object,and uses the normative research method,comparative research method and case study method to study how to regulate the government’s breach of contract in the investment promotion contract.By combing the relevant typical cases,this paper analyzes the performance types of government default in the investment promotion contract,summarizes the internal and external causes,analyzes the current problems,and draws lessons from the experience of foreign local governments in the performance of investment promotion contracts.It is suggested to clarify the government functions in the investment promotion,improve the project contract terms,improve the legal system,strengthen the government’s integrity supervision We will improve the mechanism of keeping promises and the remedy mechanism for breach of contract,so as to create a good environment for the healthy and sustainable development of the economy.
