On The Legal Protection Of Consumers' Information Right

Due to the universal and important influence of information on people’s behavior and interests,the right of consumer information extends from the right to know to the right of personal information with the development of digital economy,becoming a "dual structure" to protect and regulate the information behavior of relevant subjects.With the change of social practice,although the right to know has been confirmed by law,under the obligation-based protection mode,the performance of operators’ informing behavior has been reduced to the defense of consumers’ infringement,which interferes with consumers’ freedom of purchasing decisions.Meanwhile,in order to realize the economic purpose of information circulation,the rights and interests of personal information have not been confirmed.However,the information obligation of operators stems from the practice prescribed by law,which makes personal information become a tool to achieve economic development and weakens the information subject status of consumers.The consumer information right constructed from the perspective of operator behavior regulation makes the legislative purpose of safeguarding the legitimate rights and interests of consumers frustrated.Consumer information right arises from the equality of the subject status and the exchange of roles in civil law,and is placed in the field of economic law to protect the legal interests of the vulnerable groups of consumer information.In order to get rid of the above predicament of legal protection,consumers’ right to information should be redefined based on the particularity of the subject,that is,to reconstruct the right to know based on the right standard and to establish the right to personal information based on the core of personal dignity.At the same time,through the improvement of the relevant rules of operators’ information obligation,that is,to construct the systematic punitive compensation system,broaden the channels for diversified consumers to obtain information and optimize the principle of informed consent.So as to achieve the value balance of fairness and efficiency between consumers and operators under the background of digital economy,and build a healthy and orderly market economy order on the track of rule of law.
