Climate Change is a long-standing global challenge that continues to bring new challenges to global governance,the goal of reducing emissions and controlling carbon is to reach “Peak carbon” and promote “Carbon neutrality” as soon as possible,which all countries have been striving to achieve since the United Nations Framework Convention on Climate Change(UNFCCC)came into being.Following up on the Kyoto Protocol and Paris Agreements,the balance of global climate governance has maintained a valuable balance,seeking climate cooperation,jointly accomplishing the task of reducing emissions and achieving green development should also be the mainstream direction.However,the European Union and other developed countries are dissatisfied with the status quo and question their environmental obligations.They ignore the principle of common but differentiated responsibilities and start to advocate“Absolute fairness” and “Formal fairness”,then the carbon border adjustment mechanism(CBAM)was put forward to prevent “Carbon leakage”.In this case,the EU carbon border adjustment mechanism has been widely studied from the economic,trade,environmental,legal and other aspects,to determine its content and value,role and impact.In view of the carbon border adjustment mechanism in theory may trigger the basic principles of the Climate Change Convention,the multilateral trading system of the impact;in practice,the high-carbon industry in our country caused a major impact.Therefore,this paper introduces the basic content of carbon border adjustment mechanism,from the perspective of climate policy and international trade rules,this paper focuses on its legal compliance,and puts forward feasible measures and schemes at home and abroad.The research on the legal issues of the carbon border adjustment mechanism can help our country oppose the implementation of the carbon border adjustment mechanism while actively dealing with the carbon border adjustment mechanism and doing a good job in preventing risks.
