| With the development of biotechnology,people pay more attention to the importance of biodiversity.Biodiversity provides the present and future material basis for human,so the biodiversity has attracted worldwide attention and research.However,due to the vast territory,scattered distribution of various biological resources,and the economic development,there are many deficiencies in China protection of biodiversity,especially the protection of the rule of law.The government bears the main responsibility to protect biodiversity,it should focus on promoting the construction of the legal system,strengthening supervision and management,promoting the improvement of judicial remedies,and guiding public participation.Firstly,this study summarizes the connotation and value of biodiversity,highlights the importance of biodiversity conservation,and puts forward a theoretical basis for biodiversity conservation in China based on the theory of ecological civilization and the theory of rule of law.Secondly,the government should not only play a leading and guiding role,but also be able to effectively provide safeguard measures,rely on the rule of law.This part analyzes the specific implementation path of the government to protect the rule of law,the practices and experiences of developed countries,developing countries and China.Thirdly,sort out the historical development of biodiversity conservation in Jilin Province.Jilin has grassland,wetland,forest and other ecological spaces.Jilin is one of the richest biodiversity areas in northern China,and has many unique biological species.Jilin provincial government has taken many measures to improve the protection of biodiversity,but still faces many problems: the legal system of biodiversity conservation lacks integrity and systematization,the functions of the government’s supervision and management departments are not clear,there are certain obstacles in environmental public interest litigation,and the public’s participation is insufficient.Finally,based on the actual conditions of Jilin Province,it is proposed that the Jilin Provincial Government should promote and improve relevant measures for biodiversity conservation,for example,promoting legislation,and completing policies and regulations with complete systems;Improving law enforcement,clarifing management authority,and optimizing settings;Promoting the administration of justice,strengthen professional construction,and promoting the improvement of judicial remedies;Guiding the whole people to abide by the law,strengthening education and promote social participation. |
