Research On Network Charity Regulation From The Perspective Of Responsive Regulation

In the 21st century,the role of charity activities has gradually diversified from the traditional function of helping the weak and needy,with diversified forms and extensive coverage.Charity activities focus on the well-being of the people from more dimensions and levels of perspective.With the gradual in-depth development of the concept and practice of"Internet Plus","Internet Plus" has also been integrated with the charity field.Compared with traditional charity fundraising channels,online charity has many advantages(values),such as low threshold,wide coverage,high efficiency,strong empathy and high sense of interaction.However,at the same time,problems such as false and inaccurate information,chaotic management of donations,and even donation fraud have also emerged,affecting the social effects of charitable activities and the healthy development of public welfare charities.In recent years,the Chinese government has formulated and introduced a series of regulatory measures from the legal and policy levels,but from the perspective of policy implementation,it still cannot meet the regulatory needs and respond to social expectations,and often falls into the trap of "one regulation is dead,one release is chaos".This paper adopts a variety of investigation and research methods,such as semi-structured interview,questionnaire and case analysis,and takes Shandong provincial government departments’ supervision over online charity activities as the research object.By studying the supervision mechanism,policy design and policy effect,this paper analyzes the existing problems in the current government’s supervision over online charity.From the perspective of the relevant theories of responsive regulation,this paper makes a deep analysis of the causes of the problems from four aspects of responsiveness,plasticity,synergy and relationship,and explores and proposes corresponding solutions.The research found that the supervision of Internet charity is still facing great challenges and pressure.The false information of Internet charity,improper use of charity fund management and uneven development of platforms are practical problems that need to be addressed and solved in the next step.The current regulation has problems such as government regulation concept solidification,regulation policy rigidity lag,regulation passivity absence,lack of self-regulation ability and so on.The responsive regulation theory is used to analyze the reasons,which are generally in four aspects:insufficient regulatory responsiveness,regulatory neglect plasticity,poor regulatory synergy and weak regulatory relationship.In view of this,the author proposes to strengthen the supervision of online charity.First,the previous supervision concept aiming at punishing and standardizing should be changed,and attention should be paid to the construction of self-supervision awareness and self-governance ability of the objects of supervision.The second is to break through the previous unitary system in which the government is a single subject,introduce more non-government regulatory forces,and build a regulatory pattern of departmental linkage and social cooperation and co-governance.The third is to break the unidirectional relationship between the regulatory subj ect and the regulatory object and establish a responsive two-way interactive relationship.To be specific,the government can improve its alternative law,mutual law and self-discipline from three aspects,revise and perfect laws and regulations,strengthen legislation in the field of online charity,improve the digital level of supervision,establish a diversified collaborative supervision mechanism,build a comprehensive supervision system,encourage and guide the public and media to participate in supervision,and give full play to the regulatory role of social forces.To guide the industry to mutual law,develop online charity industry associations,cultivate a healthy industry culture,formulate industry self-discipline conventions,and guide industry subjects to supervise and restrain each other.Cultivate self-discipline within organizations,improve the internal control mechanism of charitable organizations,enhance the awareness of self-regulation of charitable organizations,guide online fundraising platforms to carry out supervision,and stimulate the potential self-regulation ability of various participants in online charity.The above improvement measures can reduce the cost of supervision,improve the prescription of supervision and the quality of supervision,give full play to the escort role of supervision for online charitable activities,realize rational allocation of public welfare resources,and promote the healthy,orderly and rapid development of Chinese Internet philanthropy.
