Research On The Treatment Classification Of Juvenile Delinquency In China

In recent years,serious crimes of juvenile have emerged one after another,each time challenging people’s cognitive bottom line and causing huge controversy in public opinion.Behind the analysis of these cases,in addition to the reasons for the juvenile themselves,there are also reasons for the social environment and lack of educational guidance.In 2019,the "Prosecutorial reform plan from 2018 to 2022"(hereinafter referred to as the Supreme People’s Prosecutorial Reform Plan)has attracted the attention of scholars on how to solve the problems in the classification of juveniles delinquency in China.It’s worth thinking about.The first chapter of this paper is to study the basic theory of the classification juveniles delinquency to clarify the basic connotation of juvenile,delinquency and classification.From the perspectives of psychology,sociology and law,there is a perfect mechanism for this mechanism.At the same time,it sorted out the grading standards for juvenile crimes,including age grading,measure grading and treatment procedure grading,to provide theoretical support for the following research.The second chapter of this thesis is to study the basic content of juveniles’ wrongful grading punishment in our country,including two parts: guilt grading and juvenile wrongful grading punishment measures.China’s existing crime and wrong classification includes age classification and wrongful behavior classification.According to the law,wrongful behavior is divided into three categories: bad behavior,serious bad behavior and criminal behavior.The grading measures for minors mainly include criminal punishment measures and non-criminal punishment measures.Punishment measures.The third chapter of this paper is an empirical study on the current juvenile wrongful punishment in China.Through the analysis of the juvenile wrongful situation and juvenile punishment measures in our country,it studies the juvenile wrongful crime and wrongful punishment in the sample.According to the implementation of the measures,it is found that the juvenile’s wrongful behavior is mainly related to property,and the treatment measures applied in practice are also different.The fourth chapter of this paper,based on empirical research,proposes that China’s current juvenile guilt grading system is faced with unreasonable grading regulations for juvenile guilt and guilt,unscientific setting of guilt punishment measures,and juvenile guilt.Deal with problems such as unreasonable institutional settings.The fifth chapter of this paper is to put forward more appropriate and perfect suggestions for the problems existing in the wrong classification system of juvenile crimes in our country,mainly based on the existing legal basis in our country,combined with the concept of national parental power,the concept of child welfare,and crime prevention.The theory and the concept of educational punishment theory,through the scientific classification of juveniles delinquency,perfecting punishment measures for juveniles delinquency,and strengthening the cooperation between punishment agencies,etc.,aim to realize the individual classification of juveniles delinquency,while helping juveniles to return to society smoothly,it also provides reference for improving this system.
