Research On The Correction Mechanism Of Juvenile Delinquency In China

Minors are the fresh blood which are needed for national development,and the healthy growth of teenagers is related with the event of national rejuvenation directly.But the minors crimes in our country in recent years showing a variety of new features,such as younger ages,to be groups or gangs,means cruelty as adults,this kind of crime has already become the general concern of our society,how to prevent and reduce juvenile crimes has become very urgent.The physiology and psychology development,self control and plasticity of minors has many differences between adults,the author thinks that the measures and methods of correction on minor offenders must be specific,and this is the foundation of juvenile delinquency correction mechanism.In order to prevent and control juvenile delinquency and to protect their legitimate rights effectively,we will focus on how to setting up a suitable correction system and an operation mode for minors.Many developed countries and regions in the world have been practicing it for a long time,a suitable correction system for juvenile offenders is formed and based on their own reality,which make this system become scientific and reasonable relatively.And since the founding of new China,the country is also very concerned about the healthy growth of minors,continue to invest lots of manpower and material resources to protect their legitimate rights and interests.Be directed against this kind of special crimes,a series of relevant laws and regulations on prevention and punishment also be formulated,which achieved good social effects.On the other hand,compared with the developed countries,it is hard to deny our disparity,especially the correction work still has many problems need to be solved.For example,failed to control the rate of juvenile delinquency effectively,the lack of sustained attention for the necessary supervision,tracking and regulations,the lack of in-depth assistance,which make the repeat crimes proportion increased after correction when minors return to the society;and as China's juvenile community correction work started late,did not set up a relatively complete legal systems yet;also our country has not built high degrees of specialization and stable correction work staffs;the lack of scientific plans on correction project,the lack of reasonable case assessment mechanism and so on.The author believes that it is necessary to draw lessons from the western developed countries with their advanced experience on juvenile delinquency correction,and integrate with actual situation in China's local development,to practice and adjust these experiences into our national conditions,so as to promote the improvement of juvenile delinquency correction mechanism in our practice.This article is composed of four parts.The first part is a summary of juvenile delinquency analysis and correction mechanism.Through analyzing the causes and trend characteristics of juvenile delinquency,it reveals the necessity of correction mechanism.Then,from the special rectification principles of minors in China,we present the mechanism of major corrective modes such as prison corrections,community corrections and reform schools.The second part summarizes the main problems and causes of the juvenile delinquency correction mechanism in China.From the integrity,distinctiveness,professionalism and effectiveness of the mechanism,we find deficiencies in reality.The third part is the extraterritorial reference for the correction mechanism of juvenile delinquency.The United States,France,Japan and Germany,which are relatively welldeveloped countries,then compared with our current correction work.The fourth part is the suggestion to the correction mechanism of juvenile delinquency in China.Combined with other countries' advanced experience,it puts forward five countermeasures from prison correction,community correction,criminal record archiving,re socialization and correction team construction.
