Research On Administrative Law Enforcement Of Entry-exit Frontier Inspection

Administrative law enforcement of exit/entry border inspection refers to an administrative activity in which border inspection authorities carry out inspection and supervision on people entering or leaving the border and their articles,means of transport and goods.Border inspection and law enforcement agencies undertake the task of exit/entry border inspection at ports open to the outside world and are an important part of state organs.With the deepening of the concept of a community with a shared future for mankind,the economic,political,military and other aspects of countries are increasingly closely connected.After China’s accession to the WTO,various resources have been mutually distributed worldwide,and the right to import and export has been gradually opened up.More and more domestic enterprises have entered the domestic market.Entry and exit activities are more active and extensive.Entry-exit border inspection has become the focus of the world’s attention as it ADAPTS to the development of the new era.In order to meet the needs of the new situation of comprehensively promoting administration by law,this paper starts from the research status of domestic scholars,explores the research achievements of relevant scholars in the United States,the European Union and Japan,expounds the content and power source of administrative law enforcement in border inspection and demonstrates the basic principles and legal characteristics of administrative law enforcement in border inspection from the definition and system of administrative law enforcement in administrative law enforcement and entry-exit border inspection.Based on the practical legal practice,this paper makes an in-depth analysis of the difficulties faced by the administrative law enforcement work of the local entry-exit border inspection,and summarizes the urgent problems faced by the administrative law enforcement work of the current border inspection as follows: Under the historical influence of the transition to a society ruled by law,the border inspection legislation lags behind and the lack of policies,the lack of evaluation,incentive and elimination mechanism,the lag of the construction of administrative law enforcement team makes the border inspection administrative law enforcement team lack of a certain standard and professional consciousness.The overall investment in scientific research is low,resulting in insufficient information construction in border inspection law enforcement.In addition,under the influence of economic development and diversification of interests,the problem of relatively lagging emergency management of border inspection was exposed after the epidemic.This paper aims at the problems and causes of the deficiencies in the administrative law enforcement of border inspection,and puts forward targeted countermeasures.It is suggested to start from improving the supporting system and policy of the entry-exit border inspection administrative law enforcement,unify the legislation and maintain the independence of the law,establish the entry-exit border inspection administrative law enforcement system and standardize the law enforcement procedures.It is suggested to strengthen the personnel training of the border inspection team,strengthen the construction of evaluation,encouragement mechanism and supervision system,at the same time,strengthen the information construction and scientific research investment,make full use of the advantages of the Internet,improve the way of administrative law enforcement,improve the efficiency of law enforcement.Finally,in the context of the era,we should actively improve the ability to deal with sudden crises.From theory system to practice,this paper puts forward effective suggestions for improving border inspection administrative law enforcement.
