Research On The Commercial Court Path Of Legalization Of China’s State-owned Business Environment

Countries all over the world,including China,have gradually realized that the high-quality development of their own economy needs the support of the necessary condition of continuously promoting the legalization of the business environment.To a great extent,the legalization of the business environment is inseparable from the specialized and professional judicial organization,which is often referred to as the national commercial court.Based on this,in 2018,China’s International Commercial Court came into being.The role and shortcomings of this important judicial organization in promoting the legalization of China’s state-owned business environment,and how to improve it,have become issues worthy of attention from all walks of life.On the basis of summarizing the existing research results at home and abroad,and referring to the standards of the World Bank’s Doing Business Report,this paper makes a comparative analysis of three representative commercial courts,namely,the British Commercial Court,the Dubai International Financial Center Court and the Singapore International Commercial Court,and summarizes the enlightenment that can be used by our country from three aspects: intelligent construction of courts,litigation procedures and alternative dispute resolution.Combined with the current judicial practice of China’s international commercial courts,a series of practical improvement measures are put forward: on the basis of further promoting the construction of intelligent courts,providing efficient and low-cost judicial services for all parties to disputes;While guaranteeing the professional level of litigation procedures,it also promotes the recognition and enforcement of domestic judgments in other jurisdictions by signing bilateral and multilateral treaties and agreements,memorandums of cooperation,etc.Under the publicity of strengthening the application of alternative dispute resolution methods in China’s international commercial courts,the rapid settlement of disputes can be promoted by expanding arbitration and mediation institutions and actively exploring a new mechanism for the connection between arbitration and mediation.Finally,by gradually implementing the above-mentioned improvement measures,it is hoped that under the existing subjective and objective conditions,China’s international commercial courts can play their greatest role in promoting the legalization of the business environment.
