Research On The Legal Dilemma And Countermeasures Of Grass-Roots Comprehensive Administrative Law Enforcement Reform In China

With the deepening of the reform of power of relatively concentrated administrative punishment,that of the comprehensive administrative law enforcement in our country has gradually carried out toward the grassroots.With growing grassroots departments conducting reform of comprehensive administrative law enforcement,increasing fields have right of law enforcement and the number of departments related to law enforcement also increases,making the reform of comprehensive law enforcement at the grass-roots level involved in all aspects of social life.In light of the practice of our comprehensive administrative law enforcement at the grassroots level,the grassroots comprehensive administrative law enforcement refers to the reform of comprehensive administrative law enforcement in the county-level,such as cities,towns,and districts.The implementation of reform of comprehensive administrative law enforcement at the grassroots level is in response to the urgent needs of current administrative law enforcement at the grassroots level,and is of great significance to promote the construction of the grassroots government under the rule of law and protect the legitimate interests of the grassroots people.At present,all parts of our country have promoted the grassroots administrative law enforcement,integrating the resources of administrative law enforcement agencies,administrative law enforcement power and administrative law enforcement personnel(strength)to establish the way of new law enforcement operation mechanism,so as to form various types of comprehensive administrative law enforcement,for instance“1+X” comprehensive administrative law enforcement;In terms of practical effect,the reform of comprehensive administrative law enforcement at the grassroots level has improved the efficiency of administrative law enforcement at the grassroots level to a certain extent,curbed the abuse of power of administrative law enforcement at the grassroots level,and enhanced the effect of administrative law enforcement at the grassroots level to some extent.While affirming the positive results of the reform of comprehensive administrative law enforcement at the grassroots level,we should also keep a clear understanding of the problems facing the reform of comprehensive administrative law enforcement at the grassroots level.From the point of view the use of administrative power at the grass-roots level,the problems existing in the reform of comprehensive administrative law enforcement mainly include insufficient degree of specification of the decentralization of administrative law enforcement,lack of bearing capacity of administrative law enforcement,imperfect institutional mechanisms of administrative law enforcement,as well as imcomplete supervision system for the comprehensive administrative law enforcement power at the grass-roots level,etc.Taking these problems into consideration,from a macro perspective,it is essential to further strengthen the systematic top-level design of comprehensive law enforcement reform at the grassroots level,so as to establish the dominant position of rule of law thinking in comprehensive law enforcement reform at the grassroots level,and promote the continuous deepening of comprehensive law enforcement reform at the grassroots level in response to practical needs.When it comes to specific countermeasures,the aspects can be improved as follows,standardizing the decentralization of power of comprehensive administrative law enforcement at the grass-roots level,strengthening the bearing power of comprehensive administrative law enforcement at the grass-roots level,improving the system and mechanism of comprehensive administrative law enforcement at the grass-roots level,and perfecting the supervision system of comprehensive administrative law enforcement at the grass-roots level.
