Researchn On The Definition Of Scope Of Supervision Object

After the promulgation of the supervision law in March 2018,the supervision system reform began to be implemented throughout the country,and the supervision committees at all levels were successively established.Compared with the previous supervision organs,the newly established supervision committees have greater power and a wider range of supervision objects.Article 15 of the supervision law also lists the scope of the objects of supervision,including six categories.However,there is no consensus on the specific scope of these objects in theory and practice,and there are different opinions.Although the regulations on the implementation of the supervision law promulgated by the state last year have more detailed provisions on the scope of the supervision objects,there are still some ambiguities that need to be carefully studied.Through the analysis and induction of different viewpoints on the definition of the supervision object,combined with the actual situation of our country,we can start with the provisions of the legal provisions in the supervision law,and take public officials and public power as the two standards for the definition of the scope of the supervision object.Public officials refer to those who hold certain positions in relevant organizations and have corresponding management responsibilities.The public power in the public power standard refers to the public power of the state and the public power of the society.The personnel who exercise these two public powers in the relevant organizations are the objects of supervision.In addition,disputes arising from the inclusion of judges in the monitoring object can be resolved by defining the supervision boundary of the monitoring committee and realizing the coordinated operation of the judge’s disciplinary mechanism.How to supervise the people’s congress deputies who perform the duties of the people’s Congress.We can analyze the characteristics of the people’s congress deputies exercising their functions and powers,find the key points of supervision,and realize the accuracy of supervision.As for the newly emerged problems in the regulations on the implementation of the supervision law that the scope of supervision objects in statutory inspection and quarantine institutions and industry associations is not clear,the scope of supervision objects can be accurately judged by using the two standards of public officials and public power.
