Study On The Interactive Relationship Between Network Public Opinion And Administrative Law Enforcement In The Construction Of Government Ruled By Law

In recent years,with the popularization of the Internet and intelligent terminals,the public has a strong tendency to participate in public discussion with the help of mobile terminals.When the majority of the public participate in an event and express their feelings,opinions and attitudes intensively,the event will continue to ferment and attract more attention from the public and the media,thus forming online public opinions.Through the analysis of network public opinion in recent years,it is found that many public opinions involve administrative law enforcement,which has both the network public opinion caused by the anomie of administrative law enforcement,and the administrative law enforcement anomie caused by the pressure of public opinion,and even caused secondary public opinion.In this paper,through field research,real-time tracking of public opinion trends,interviews with research objects and other ways to obtain the first-hand information of political network public opinion in Henan Province,forming a sense of the problem.Combined with the theory of government under the rule of law,due process theory,collaborative governance theory,etc.,using empirical analysis,case analysis and inductive analysis,and taking the collected case materials and literatures of Henan Province as the logical starting point,the interactive relationship between online public opinion and administrative law enforcement and its optimization path were explored.In addition to the introduction and conclusion,the text is divided into four parts:The first part is the investigation and analysis of the interaction between online public opinion and administrative law enforcement in Henan Province.This paper mainly introduces the method and purpose of this survey,the data survey and statistical analysis of network public opinion related to administrative law enforcement,and expounds the value basis of the research and analysis based on the theory of government by law,due process theory and collaborative governance theory.The second part analyzes the interactive relationship between network public opinion and administrative law enforcement.On the one hand,it reflects the benign interaction between the two.Online public opinion supervision reveals the problems existing in administrative law enforcement,promotes fair law enforcement,promotes the improvement of quality and efficiency of administrative law enforcement,and highlights its positive side.On the other hand,it reflects the bad cycle of the two.The misconduct of administrative law enforcement,such as violation of discipline and lack of evidence,gives rise to online public opinion,and the improper performance of administrative law enforcement responsibility aggravates online public opinion.Public opinion pressure may lead to procedural flaws,heavier punishment results and other administrative law enforcement anomie.The third part mainly discusses the obstacles of benign interaction between network public opinion and administrative law enforcement.Based on the analysis of research data,this part analyzes the obstacles to positive interaction between the two from four aspects:imperfect laws and regulations on the disposal of public opinion,insufficient attention to the right of public expression in administrative law enforcement,irregular phenomenon of administrative law enforcement behavior,and artificial creation of public opinion by using anomie of administrative law enforcement.The fourth part,based on the above analysis,proposes strategies to promote the positive interaction between network public opinion and administrative law enforcement from the perspectives of perfecting legislation,protecting rights,standardizing law enforcement and building the legal capacity of government public opinion disposal.Building a government under the rule of law is a key task and main project of comprehensively promoting law-based governance,and bringing government actions into line with the rule of law is also part of the overall goal of realizing the 2025 goal.We will continue to enhance our ability to respond to emergencies,improve the quality and effectiveness of administrative law enforcement,and improve the government governance system with clear responsibilities and law-based administration.
