| The current COVID-19 prevention and control situation is still grim,affecting the whole society.The epidemic is sweeping the world.Today,with the rapid development of science and technology,compared with the SARS outbreak in 2003,the advantages of big data in the process of fighting the epidemic are particularly obvious.We are in a critical period of fighting against the epidemic.Big data can help us better analyze the current situation and judge the infection risk of relevant personnel,which plays an indispensable role in winning the battle against the epidemic.However,everything is like a coin with two sides.Personal medical information is collected in a wide range in various scenarios,and the risk of its infringement will rise sharply.Therefore,the situation of personal medical information protection is not optimistic.After the promulgation of the Personal Information Protection Law,the level of personal information protection has been strengthened unprecedeningly.However,as far as personal medical information is concerned,it has great particularity,and the traditional way of personal information protection is not enough to fully protect personal medical information.Therefore,it is necessary to construct a protection mechanism for personal medical information in line with current national conditions from the perspective of administrative law,and combine it with public power to find out what defects exist in the protection process of personal medical information under current administrative law,so as to fully respond to new challenges.Nowadays,there are many kinds of behaviors violating personal medical information,including improper collection,improper disclosure and improper utilization of personal medical information by civil subjects and administrative subjects.This article aims to discuss the problem of infringing personal medical information in detail,and analyze the problem of legislation,law enforcement and relief of personal medical information from three angles,and put forward targeted countermeasures and suggestions for the protection of personal medical information under administrative law,so as to carry out more comprehensive protection. |
