Study On The Principle Of Synergy In Biosecurity Law

Principle of synergy is officially included in Biosecurity Law,which thus presents new study and analysis perspectives as well as governance ideas for new environmental risks resulted from biotechnology.On one hand,this principle is conducive to promoting biosecurity rule design and system operation at the macro-idea and micro-practice levels;on the other hand,it helps construct the synergy of normative theory,organization theory and action theory of biosecurity risk regulation.However,it is worth noticing that the principle of synergy is accompanied by problems in legal interpretation,normative construction and application of principles.In this context,it is necessary for the academic circles to delve into deep-seated problems such as generation mechanism,legal implication,and system development of the principles of synergy in Biosecurity Law.Specifically,this principle covers normative elements and substantive connotations.For the former,it includes synergy of normative goals,organizational design,and action paths;for the latter,it lies in legal values stemmed from national security interests,ecological security interests,and human security interests.Regarding the institutional development of this principle,attention should be given to biosecurity central-local work synergy,biosecurity social synergy and linkage,biosecurity information release and sharing,as well as biosecurity incident traceability synergy.In this way,it succeeds in an overall transformation in multiple aspects,such as from traditional “five” environmental basic principles to current “six” basic principles,from the synergy system to the inter-system synergy,from fragmentation to “integrated + categorized” governance,and from individualism to ecological holism methodology.The principle of synergy in the post-Biosecurity Law era should change from substantive normative interpretation to practical application of principles.Accordingly,limitations of polycentric governance theory should be settled,and this principle can be realized through the systematic theoretical mindset and methodology,while its relationship with other principles should be clarified.Besides,it is also necessary to go beyond its narrow sense and the traditional top-down rule of law of bureaucracy.Then under its broad sense,it should ensure self-consistency and distribution of the biosecurity normative system,and explore the long-term mechanism of biosecurity risk prevention and control.Based on this,a cogovernance pattern with multiple entities will be formed for biosecurity.
