With the promulgation and implementation of the Biosafety Law of the People’s Republic of China,China attaches great importance to biosafety.Biotechnology is a "double-edged sword",which can not only benefit human survival and development,but also lead to biosafety problems due to misuse and abuse,unexpected public health events that affect social stability,and even human security.Biotechnology science level in our country in the process of continuous development,biological experiment the researchers hope that through the experimental study was carried out on the experimental animals,to analyze its genetic characteristics and its nature of a virus or to carry to experimental animals for drug development and medical research,laboratory in colleges and universities and other institutions of experiment and research more,naturally,The demand for laboratory animals also increased.The corresponding biosafety problems caused by experimental animals are also worthy of our attention.There are many cases of damage to national production economy and life safety caused by the spread of pathogenic microorganisms carried by experimental animals themselves.The establishment of the standard content of experimental animals,the production,purchase and feeding of experimental animals,as well as the experimental technology and waste disposal issues during the subsequent experimental operation of experimental animals,any of these links lack of legal norms and mandatory provisions to regulate and restrain may lead to potential biosafety risks and risks.Through the analysis of the possible biosafety problems caused by experimental animals and their causes,this paper draws the following conclusions from the two aspects of legislation and law enforcement: the legislative concept of experimental animals lags behind;The legal regulations on experimental animals have lower levels of validity and are less mandatory and restrictive.Experimental animal related legal norms have not formed a perfect legal system,legal norms scattered;The rights and responsibilities of law enforcement bodies are not clear and the coverage is not perfect.The process of law enforcement supervision and supervision is not strict,and the mandatory legal regulation is not in place;General laboratory related to the regulation of biological safety of the legal norms are seriously inadequate,poor supervision.Based on the above causes and combined with the current status of the biosafety system,this paper analyzes the specific ways to improve the legal and normative system of the biosafety of experimental animals and the law enforcement supervision and management mechanism,and further puts forward relevant suggestions to improve the biosafety of experimental animals by law.The continuous improvement of China’s experimental animal biosafety system will bring the experimental animal biosafety supervision and management mechanism into the track of rule of law as soon as possible,realize the unification of national biosafety laws,and then promote the modernization of national governance system and governance capacity in the field of biosafety.It can form a solid guarantee for the improvement of China’s biosafety system and the life and quality of citizens as well as national economic production.
