The normal operation of human society is closely related to the network,and with the rapid development of network information,it brings us convenience but also brings some unpredictable challenges and risks.Nowadays,international terrorist forces have taken advantage of the Internet to launch cyber terrorist attacks,which have buried deep hidden dangers to the security of countries,societies and cyberspace in all countries in the world.The network terrorism formed by the integration of traditional terrorism and the network provides a hotbed for terrorists to spread ideas and develop themselves,breaks through the original time and space restrictions,reduces the criminal cost of terrorist activities,and is more destructive.Terrorists use the convenience and covert of the Internet to carry out a series of activities,such as recruiting terrorists through websites and software channels;The use of encrypted websites to teach violent terrorist technology,launch cyber-attacks,etc.,in this process presents more professional,decentralized and disorderly characteristics,the current cyber terrorist activities are increasingly seriously affecting the security and stability of the world.Countering cyber terrorism is a major task on a global scale,and it is difficult to achieve this by relying on the strength of one country alone,but an effective international coordination method has not yet been established,and a comprehensive special international convention on cyber terrorism has not yet taken shape.This article begins with a discussion of what constitutes a cyber terrorism crime.It should be highlighted that compared with the particularity of traditional network terrorism crimes,terrorist organizations have changed the traditional recruitment and training mode in network terrorism crimes,and began to use the network to recruit high-tech terrorists and teach and train violent terrorist techniques,which in this process reduces the cost of crime and strengthens the destructive and concealed type of criminal activities,making terrorist attacks more networked,terrorist organizations and terrorists more decentralized and professional,which paves the way for subsequent analysis of China’s punishment of cyber terrorism.The second part starts from the three levels of the United Nations,regional international organizations and countries,and describes the specific norms that currently exist in the international community on punishing cyber terrorism crimes.For example,the United Nations Global Counter-Terrorism Strategy to punish cyber terrorism crimes under the Joint Framework,the Shanghai Convention on Combating Terrorism,Separatism and Extremism by regional international organizations to punish cyber terrorism,and the relevant laws and norms formulated by typical countries on cyber terrorism crimes.The third part is to make recommendations on the punishment of cyber terrorism crimes at the international level,including the construction of substantive law,the setting of procedural law,and international cooperation.Part IV provides a detailed analysis of the current situation,dilemma and suggestions for improving China’s response to cyber terrorism crimes,including the relevant international treaties to which China is a party and the relevant laws and regulations formulated in China against cyber terrorism crimes,the predicament including the lag in domestic legislation,the weakness of cyber terrorism intelligence technology,and the lack of international cooperation in cyber terrorism.On the basis of the foregoing,it puts forward feasible suggestions on China’s cyber terrorism crime punishment measures from the three levels of law,technology and international cooperation,and explores a counter-terrorism model suitable for China.
