| With the rapid development of Internet media,the gradual popularization of mobile devices,ultra-high-definition broadcasting and other technologies continue to advance,and watching major sports events through the Internet live broadcast platform is favored by the majority of audiences.The economic value brought by sports events is getting higher and higher,and traditional radio and television stations and emerging Internet media platforms have also obtained a large number of traffic dividends through live broadcast of events.The continuous emergence of the phenomenon of piracy infringement of live sports events is not only due to the huge economic benefits of the events themselves,but also the impact of people’s weak awareness of copyright protection of live sports live images and imperfect protection work.In this context,this paper hopes to study the current situation and problems of copyright protection of live sports events,and put forward some practical suggestions for the legislative and judicial protection of copyright of live sports events,so as to curb the occurrence of piracy infringement.Firstly,this paper sorts out the relevant concepts and characteristics of live sports event screens,and clarifies the necessity of their protection: to ensure the healthy development of the live broadcast industry of sports events;reducing the incidence of piracy infringements;Improve the audience’s awareness of copyright protection and develop the habit of paying online.By analyzing the current situation of copyright protection of live sports live images under China’s Copyright Law and other laws,China has promulgated relevant laws and regulations at the national and local levels,but there are still problems such as unclear characterization of live sports events,inconsistent standards for judging the originality of live sports events,and weak awareness of copyright protection of live sports events.In judicial practice,the inconsistency of the originality standards of live sports events and the unclear legal attributes of sports events lead to the phenomenon of "different judgments in the same case",and there are differences in the basis for the protection of related infringement cases,mainly with three views: copyright protection;It shall be protected by the Law against Unfair Competition and the protection of neighboring rights to live sports events with video recordings.In addition,people’s awareness of copyright protection of live sports live images is weak,and they have not formed the habit of paying for online viewing.By examining the relevant legal systems for the copyright protection of live sports events in foreign countries,it has some enlightenment for relevant issues in China: the protection of live sports event pictures with "works";In terms of legislation,the standards of common law countries for judging the originality of works can be referenced;In judicial practice,the originality of the picture should be analyzed in light of individual cases.Through research,this paper argues that the copyright of live sports events can be protected in three ways: first,the live broadcast of sports events is included in "audiovisual works";the second is to improve the judgment standard of China’s originality;Finally,by popularizing knowledge about copyright protection of live sports events,people’s awareness of copyright protection is raised and infringement is avoided. |
