Exploration Of Public Surveillance Execution System In China

As a unique non-imprisonment penalty in China’s main punishment,the public surveillance is in line with the trend of light punishment in the world and has a series of advantages that prison punishment does not have.It should be widely used in minor crimes,but due to the short establishment,the enforcement system is not perfect,and the enforcement effect is not ideal.These factors have resulted in the low application rate of public surveillance in practice,and it cannot play its unique role in crime prevention.Therefore,how to give full play to the advantages of the theory and system of public surveillance,enhance the execution effect of public surveillance,and improve the judicial application rate of public surveillance is crucial.The key point is to make a fuss about the implementation,start with optimizing the execution method,and improve the correction effect,etc.These efforts will further improve the enforcement system of public surveillance.This thesis is composed of four parts.The first part discusses the relevant concepts of the enforcement system of public surveillance and expounds the historical evolution and current situation of the execution of public surveillance.It also expounds the theoretical advantages of the execution of public surveillance through discussing the compatibility of relevant theories of community corrections,such as the value of punishment,purposes of punishment,functions of punishment,the trend of light punishment,and the theories related to community correction.The second part expounds the current situation of the execution of public surveillance by discussing the basis,institution,place,content,and execution effect of the execution of public surveillance.The third part summarizes and analyzes the existing problems and reasons of the current execution of public surveillance.Due to the shortcomings of the existing execution system in targeted,punitive and compulsory aspects,the current execution effect of public surveillance is not ideal.This part provides directions for the optimization of the criminal execution system.The fourth part proposes targeted improvement suggestions in the aspects of evaluation mechanism,execution method,and reward and punishment mechanism.These suggestions are provided for the improvement of the enforcement system of public surveillance,and to contribute modestly to its improvement and development.
