On Improvement Of Public Surveillance

Public Surveillance is a kind of penalty created by our country, which is the only non-imprisonment penalty measure among our national five principal penalties and suitable for application in community correction. The existence of Public Surveillance has made up for the deficiency of short-term free imprisonment to some extent and guaranteed perfection of our national penalty system. Its judicial resources saved because of low economic cost can be used to promote the development of professionalization and scientification of our national prison reform. With general trend of global penalty gradually at present going to lightness and slowness, Public Surveillance supplies the implementation of our national community correction with stable suitable channel and broad mass base that are not possessed by other corrective measures. Therefore, although Public Surveillance has some inapplicability and suggestion of abolishment in academic circles has been continuous, after weighing the pros and cons, Public Surveillance not only shouldn't be abolished but also should be paid more attention to and applied more extensively. The defects of Public Surveillance can be overcome, and its superiority will be brought into full play after improved, developed and combined with some new theories and methods of current community correction after a period of time.Based on the condition of community correction experiment conducted extensively, this thesis has deeply probed into the historical origin and evolution process of Public Surveillance, explained the connotation and value in new condition and new period, objectively introduced the status quo of community correction at home and abroad, probed into the relation between Public Surveillance and domestic community correction in addition to its effect on community correction, and finally put forward specific perfection suggestions based on existing problems and defects in current Public Surveillance.
