Comment And Analysis On The Construction Of Inner-party Supervision Laws And Regulations System Of The Communist Party Of China

In 2016,the CPC Central Committee issued the opinions on strengthening the construction of inner-party laws and regulations.According to the different adjustment objects,the inner-party laws and regulations are divided into four categories: Party organization laws and regulations,Party leadership laws and regulations,Party self construction laws and regulations,and party supervision and guarantee laws and regulations.Inner party supervision is an activity that the party supervises and restricts the behavior of Party organizations and Party members in a certain way.Inner party supervision laws and regulations are an important basis for reasonable and orderly inner-party supervision activities.Since the 18 th National Congress of the Communist Party of China,the construction of inner-party laws and regulations has been "fragmented" and has achieved certain results.From the perspective of effectiveness system,the inner-party supervision legal system is an inner-party legal system with the party constitution as the general program and various norms,regulations and methods as the specific follow;From the perspective of the system of division of labor,the system of laws and regulations of inner-party supervision stipulates the specific contents of inner-party supervision,such as principles,methods,subjects,procedures,division of labor and so on;From the perspective of implementation methods,the inner-party supervision regulations stipulate a series of specific supervision methods,such as central organ supervision,Party committee supervision,patrol supervision,democratic supervision and so on.The research on the existing inner-party supervision laws and regulations system is helpful to correctly understand and apply the inner-party supervision laws and regulations,and the prospect of the construction of the inner-party supervision laws and regulations system is helpful to scientifically plan and formulate the inner-party supervision laws and regulations,so as to improve the organic whole of the laws and regulations system governing the party.On the whole,this paper is divided into three parts.The first part discusses the basic theory of inner-party supervision regulations,the second part discusses the system composition and implementation mechanism of inner-party supervision regulations,and the third part is the prospect of the construction of inner-party supervision regulations system.The main contents of each chapter are as follows:The introduction includes the research background,research significance,research status and research methods of this paper.Specifically,it describes the era background,law construction background and realistic demand background of the construction of inner-party supervision law system;It points out the significance of the construction of inner-party supervision laws and regulations system to improve the inner-party laws and regulations system and the socialist system with Chinese characteristics,and give full play to the important role of inner-party laws and regulations in governing the party;The research status of this field is analyzed;The research methods of this problem are introduced.The first chapter introduces the legal basis of the inner-party supervision regulation system,mainly including the definition of the concept and constituent elements of inner-party supervision,the introduction of the connotation and development history of inner-party regulations,and the discussion of the relationship between inner-party regulations and the socialist legal system with Chinese characteristics.The research of this part helps to clarify the relevant concepts of the inner-party supervision legal system,deeply grasp that the inner-party supervision is an important way to manage the party,and the construction of a scientific and reasonable inner-party supervision legal system is the basic premise to give full play to the energy efficiency of the inner-party supervision system.The second chapter is the research and experience summary of the development history of inner-party supervision laws and regulations."Taking history as a mirror,we can know the rise and fall." The development and construction of inner-party laws and regulations of the Communist Party of China is not achieved overnight,and the laws and regulations involving inner-party supervision have also experienced tortuous development for a century.The inner-party supervision laws and regulations in different historical periods have different principles,contents and methods due to different times and historical tasks.Through the analysis of the construction process of the inner-party supervision law system from the founding of the party to the 18 th National Congress of the party,it is helpful to summarize the historical experience and lessons and guide the development and improvement of the inner-party supervision law system in the new era.The third chapter is the proper conception of the inner-party supervision system.As a political tool,inner-party supervision regulations should conform to certain spirit and principles;As a legal form,the inner-party supervision regulations should conform to the general legal construction form,with self-consistent formulation of norms,as well as entities and procedures;As a supervision mechanism,the inner-party supervision laws and regulations should have special standards to meet the decision and deployment of the Party Central Committee to comprehensively and strictly govern the Party work.The fourth chapter focuses on the study of the existing inner-party supervision regulation system,that is,the actual composition of the inner-party supervision regulation system.The system of inner-party supervision laws and regulations is similar to the legal system,which has both a vertical effectiveness system and a horizontal division of labor system.The effectiveness system means that the inner-party supervision laws and regulations take the Party Constitution as the general program,and take various regulations,guidelines,methods,etc.as the specific compliance;The division of labor system means that different systems stipulate the principles,methods,subjects,procedures,division of labor and other specific contents of inner-party supervision.At the same time,the inner-party supervision regulations,as a restrictive norm,intersect and link up with the national laws in some parts,which together constitute the overall supervision system of our country.The analysis of this part will help to control the inner-party supervision and regulation system from a macro perspective,and grasp the organic links between various separate regulations,methods,guidelines and other supervision norms.The fifth chapter is the prospect of the construction of inner-party supervision law system.System construction is a process of continuous improvement and development.We should not only clarify the core idea of systematic construction,but also take scientific theory as the construction guidance,but also respond to the needs of the times.It should be recognized that the current inner-party supervision laws and regulations are very rich,but the degree of systematic construction is insufficient.There is a certain room for improvement in both the overall guiding ideology and specific implementation measures.Therefore,this part focuses on the ideological basis,effectiveness system and key points that should be followed in the construction of inner-party supervision law system,and makes innovative research on the specific supervision system.
