Research On The Legislation Of Tibet Autonomous Regional People’s Congress From The Perspective Of Legislative Function Of Ethnic Autonomous Areas

In the "unified,hierarchical" legislation system,as an indispensable portion in ethnic legislation system of local legislation,has the dual nature of the dependency and autonomy,the dual attributes lead on the implementation of legislation and the independent legislation(legislation)contains the antecedence two functions,legislation and a more autonomy of ethnic autonomous areas the function of legislation.The evaluation of the legislation of ethnic autonomous areas can start from the realization of these three functions,which can clearly clarify the achievements of the legislative work of ethnic autonomous areas and the future planning direction.By comparing the data of the National People’s Congress legislation of each ethnic autonomous region and the legislative situation of various cities in Tibet Autonomous Region,this paper holds that the legislative work of the people’s congress of Tibet Autonomous region pays attention to the implementation of legislation,dares to explore the autonomy of legislation,and has achieved remarkable results.However,there are also some shortcomings,and there is room for further improvement in the realization of legislative functions.Based on the data analysis,this paper puts forward that the future legislative work of the People’s Congress of Tibet Autonomous Region should be based on the opportunity of building the ecological security barrier of the Qinghai-Tibet Plateau.Do a good job of independent legislation with distinctive principles;Emphasis should be placed on the implementation of the legislation,so that the ethnic local legislation tends to be more perfect and better realize its due function.The Tibet Autonomous Region plays a dual role in legislation and an important link between the preceding and the following.The Tibet Autonomous Region has jurisdiction over both local legislation at the provincial level and regional ethnic autonomy.It undertakes the task of implementing legislation at higher levels and provides guidance and guarantee for the reform and development of local legislation.At the same time,it is necessary to examine and supervise the legality of autonomous laws and regulations legislated by autonomous regions.This shows that the Tibet Autonomous Region plays a very important role in guiding and guaranteeing the reform and development of ethnic minority areas,maintaining the unity of the socialist legal system,and promoting the improvement of the socialist legal system with Chinese characteristics.In August 2015,the Sixth Central Symposium on Work in Tibet affirmed that "administering Tibet in accordance with the law,enriching the people and prospering Tibet,building Tibet in the long term,rallying the people and consolidating the foundation" is the basic policy for the governance of Tibet in the new era.In the face of the special problems facing Tibet in the new era,reform and development,environmental governance,ecological protection and other issues,it is necessary to adhere to the rule of law in Tibet.The continuous progress of the rule of law has provided a strong legal basis and source for local legislation in Tibet.Therefore,the new socialist Tibet is actively exploring the road of rule of law with Chinese characteristics and in line with the characteristics of Tibet,establishing a legal fortress for the long-term stability of Tibetan society,and escorting the development and long-term stability of Tibetan society with high-quality legislation.
