The "Rule of Law China Construction Plan(2020-2025)" for the legislative workforce building,requires the integration of local legislative work practice,give full play to the leading role of the NPC in the legislative work,and take the initiative to play a role in promoting the construction of the rule of law in China.The new era of local legislation proposed in the report of the twentieth session on local legislation,local legislation has ushered in a new era,the legislative work of local people’s congresses in Tibet in reviewing the historical achievements made,but also to realize that there are many problems in the legislative work of local people’s congresses in Tibet,therefore,this paper discusses the main problems of the legislative work of local people’s congresses in Tibet.In order to better explore the problems in the legislative work of local people’s congresses in Tibet,we first clarify a series of conceptual meanings and the evaluation criteria for formulating local regulations.Secondly,we also find out the past achievements of the legislation of Tibetan local development people’s congress,and comprehensively sort out the number of effective,modified,repealed and invalid regulations,and also sort out some regulations.Then to pave the way for exploring the problems in the legislative work of local people’s congresses in Tibet,the public and local people’s congresses are the democratic foundation and core force of local legislation,but in the work of local people’s congresses in Tibet,objectively they do not play the expected theoretical role.This paper is divided into five parts.The first part is the introductory chapter,which discusses the background,significance and literature review of the study.The second part is the second chapter,which introduces the meaning of local people’s congress legislation,the meaning and importance of local people’s congress legislation in Tibet and the legislative achievements made by local people’s congresses in Tibet in the past 40 years,From the clear set of concepts and achievements,on the one hand,the legislative work of the local people’s congresses in Tibet has been steadily and solidly progressing and fruitful,On the other hand,it can pave the way for exploring the problems in the legislative work of local people’s congresses later on.Local people’s congress legislation is a direct reflection of the wide range of public participation in legislation,and public participation does not seem to play a maximum role in the legislative work of local people’s congresses.The third part is the third chapter,on the basis of the second chapter,it starts to systematically discuss the problems in the legislative work of local people’s congresses in Tibet,and these problems are summarized and sorted out respectively,in the legislative work of local people’s congresses in Tibet,there are problems such as the inadequate use of legislative technology and the professionalism of legislators need to be improved.The fourth part,Chapter 4,analyzes what are the specific causes of these problems and finds where the problems come from,e.g.,"Knowing what’s right and knowing why".In the fifth chapter,specific suggestions and measures are given for the problems or shortcomings in the legislative work of local people’s congresses in Tibet.This paper attempts to analyze the reasons for these problems by looking at some of the problems that exist in the legislative work of local people’s congresses,using the content of the research and the information collected online,and then putting forward recommendations that are relevant and feasible.The legislative work of local people’s congresses in Tibet is one of the important means to promote local economic and social development.Developing effective laws and policies in this process requires knowledge of the relevant fields and legal principles,as well as the application of appropriate legislative techniques.Widely listen to the views and suggestions of all sectors of society and participate in the legislative process through various means.Public participation can improve the quality and legitimacy of legislation,bring the government closer to public opinion,and protect the interests of citizens. |
