Research On The Construction Of Intelligent Court Under The Background Of Court Informatization 4.0

“Smart Court” has been incorporated in Outline of the National Information Technology Development Strategy and Thirteen-Five National Information Technology Plan in 2006.Both justice for people and judicial justice have been fully combined by applying and handling Artificial Intelligence(AI),aimed at strengthening the services of litigation by Information Technology(IT)to fulfill the integrated modes,the combination of online processing service,open process,and intelligent service.In 2008,nationwide“Smart Court” has been established preliminarily.Our framework of “Smart Court” has not been finished basically until 2019,which has marked “Smart Court” into its 4.0 era.From the beginning up to now,“Smart Court” has already made certain achievements.Its trail competence has made great progress in all respects including judicial modernization,justice,convenience,and scientization through a large amount of artificial technology.“Smart Court” has been a “top-level” concept with extreme Chinese characteristics,which has requested to instill the vision of “judicature servicing people,and service facilitating people” into the whole process of judicial work.“Smart Court” is aimed at servicing clients` litigations and judges` trials and being dominated by judges and clients,can provide more convenient and efficient services through network technology and information means.Nonetheless,there are still some disadvantages and weaknesses in the process of the construction of “Smart Court”,such as the applying limitation of “talent technology”during operation and management,the loss of “justice” and “efficiency”,the skewing of construction goals,the “digital barrier” of the operation of system intelligence,the shortages of legislation and rule and judicial justice and the security of judicial data not be guaranteed.On the basis of various issues we met in the process of the building of“Smart Court”,we should maximize to insist on the goal of “fair”,avoid deviating from the technology,clear the value of “efficiency”,and conduct pragmatic performance and refine the rules in the operation of judicial intelligence.Only in these ways,we can remain a reasonable range to ensure the operation of judicial intelligence to promote support in technology and make the construction of “Smart Court” develop more efficient and faster in the era of Information 4.0.
