New forms of employment that rely on the Internet platform have won the favor of the job market for their low entry threshold and convenient exit mechanism.Under the current new situation of consumption upgrading in our country,new employment pattern is not only an important grasping method to bridge the gap between masses’ demands,but also an important carrier to meet their diversified,flexible activation and personalized needs.It plays an important role in promoting employment and promoting social equity,etc.With the increasing number of practitioners,occupational types and job types,the lack of protection of labor rights and interests has attracted increasing attention from all parties.In this paper,takeout riders in H city of A Province are taken as the research object.From the perspective of rights and interests protection,based on relevant theories of new business forms such as social equity and collaborative governance,literature research,questionnaire survey and in-depth interview are adopted.From the aspects of labor remuneration,rest and vacation,labor safety,labor contract signing and appeal expression,this paper systematically sorted out the current situation of labor rights and interests protection of the seller riders,and revealed the practical problems and causes of the labor rights and interests protection of this group.The research finds that the lack of protection of labor rights and interests of practitioners in new forms of business is mainly due to:(1)The government’s tolerance of new things causes the absence of special policies and regulations,and it is difficult to identify the labor law attributes of practitioners in new forms of business,which leads to the difficulty in implementing the supervision and management of labor supervision departments.(2)Enterprises often cleverly avoid the payment of social insurance premiums,which makes them ignore their social responsibilities.(3)Trade unions do not have the right to enforce labor laws.In most cases,they cooperate and assist.While their rights are limited,their organizational development lags behind.(4)Low level of individual human capital makes it difficult for practitioners to defend their rights,and their inferior position leads to their weak organizational rights protection,while realistic choices make practitioners ignore their labor rights and interests.Based on the promotion and protection policies implemented in other regions,this paper puts forward corresponding suggestions from the four main bodies of the government,enterprises,trade unions and new business practitioners: at the government level,the special laws and regulations applicable to the protection of labor rights and interests of new business practitioners should be perfected,and the labor relations between employees and employment units should be clarified.Enterprises to improve the internal management at the same time enhance the sense of social responsibility;The platform should promote the establishment of industrial collective bargaining system and improve workers’ trust in trade unions;Practitioners of new forms of business should start from the aspects of their own awareness of rights and interests protection and strengthening of skills and qualities,so as to safeguard their legitimate rights and interests and promote the long-term development of labor rights and interests protection of practitioners of new forms of business.In conclusion,this study reveals the common problems of the protection of the rights and interests of practitioners in new employment forms at the factual level and the institutional level,and proposes the proposed mode of implementing diversified governance for practitioners in new employment forms,so as to provide a reference for realistically designing the policy of protecting the rights and interests of practitioners in new business forms and perfecting the protection system.Figure [1] table [7] reference [58]...
