Protection Of Workers’ Rights And Interests In Platform Economy

With the development of platform economy,issues related to the protection of platform labor rights and interests continue to emerge.When working in platform enterprises,workers not only do not get equal rights,but also the road of safeguarding their rights is becoming increasingly difficult,especially platform crowdsourcing labor.Due to the consideration of platform enterprises to reduce costs and improve the operation efficiency of the platform,at present,many takeout platforms and express companies have a considerable part of their business crowdsourced to social personnel.On the one hand,this behavior can absorb social idle resources,which not only improves the efficiency of the platform,but also promotes employment and improves the income of employees.On the other hand,due to the flexibility of crowdsourcing mode,it is difficult to protect the labor rights and interests of workers on such platforms.At present,there are many difficulties in the protection of such labor rights and interests under the platform economy.In terms of legislation,the definition of workers and labor relations in China’s law is unclear.They explain each other and are difficult to be applied to judicial practice;From the judicial point of view,there is a serious phenomenon of different judgments in the cases related to the protection of the rights of platform workers,and it is difficult to formulate unified rules to restrict the judges to adjudicate.At the same time,although the government and trade unions are actively taking actions to make up for the current situation of insufficient protection of labor rights and interests,it is difficult to see results in the short term,so they can only give care and condolences in form.In the face of the increasing number of platform labor rights protection cases,the contradiction between workers and platform enterprises is becoming increasingly fierce.If no effective measures are taken,it may cause more negative consequences,such as affecting the enthusiasm of workers,making the platform enterprises unable to operate normally,and even affecting the healthy development of society.When the current laws,government,trade unions and other relevant organizations can not effectively protect the legitimate rights and interests of platform workers,the author believes that the relevant theories of corporate social responsibility can be introduced,through in-depth analysis of the measures taken to protect the rights and interests of workers in its history,and give it significance in the new economic era,So as to provide a feasible way for the protection of labor rights and interests of the platform.Corporate social responsibility can provide a new solution mode when the labor law norms are not perfect.At the same time,it can also provide relevant experience from the aspects of theory and practice to promote the improvement of labor norms.Moreover,after the improvement of labor law norms,it can continue to play a supplementary role.Based on this,the author puts forward the following suggestions: first,we should use the essence of corporate social responsibility to protect the basic rights of workers and promote the construction of relevant mechanisms.This is mainly reflected in that the government should formulate policies to guide the reform of social insurance system;At the same time,we should speed up the establishment of labor union organizations of platform labor.Secondly,we should practice and promote the specific forms of corporate social responsibility.Enterprises should establish corporate culture and guide themselves to bear social responsibility when carrying out economic activities;At the same time,enterprises should also formulate labor regulations,clarify the rights of platform workers,protect their rights and interests,and always practice corporate social responsibility.In addition,the judicial department should actively apply the relevant theories of corporate social responsibility to guide corporate behavior;Relevant government departments should also actively carry out the construction of consumer evaluation system to arouse the public’s attention and supervision on the social responsibility of enterprises.
