| As socialism with Chinese characteristics enters a new era,major social contradictions in China have also undergone significant changes,leading to continuous changes in economic construction,development concepts,and social environment.In addition to the influence of the international environment and the development of internet technology,various social contradictions and problems have rapidly increased in quantity,but also presented a trend of sharpening and complexity.Therefore,strengthening the innovative development of social governance and deepening the diversified resolution of conflicts and disputes has become one of the important political issues in China’s social development.Since the 18 th National Congress of the Communist Party of China,the Central Committee of the Communist Party of China has attached great importance to the construction of a diversified mechanism for resolving conflicts and disputes,emphasizing the need to put non litigation dispute resolution mechanisms at the forefront and promote more legal forces to guide and guide.On the one hand,the lack of a legal system for mediation and the weakening of mediation thinking have led to a large number of conflicts and disputes being resolved through litigation,and judicial resources have been unable to keep up with the pace of the increase in conflicts and disputes;On the other hand,in the face of the reality of people’s mediation mechanisms not fully exerting their effectiveness,administrative mediation gradually fading out of sight,and judicial mediation being criticized by the public,it is particularly urgent and necessary to supplement the shortcomings of the "three carriages" of the mediation system and explore the establishment of effective mechanisms for resolving conflicts and disputes.It can be seen that the construction of a comprehensive mediation mechanism plays an irreplaceable role and significance in national governance.This article is divided into five parts.The first part is an introduction,mainly explaining and analyzing the background of the topic,the current research status at home and abroad,and the research methods of this article;The second part is an overview of the issues related to the grand mediation mechanism.By comprehensively reviewing the historical origins and development process of traditional mediation systems,the theoretical core of the grand mediation mechanism is identified,and the theoretical basis and constituent elements of the grand mediation mechanism are deeply analyzed;The third part is an overview of typical models and characteristics of the mediation mechanism.By analyzing the current situation and characteristics of the specific operation process of the mediation mechanism,we can accurately identify the operation situation of the current mediation mechanism;The fourth part is the analysis of the practical difficulties and reasons of the current mediation mechanism,analyzing the problems and reasons of the current mediation mechanism from traditional concepts,system itself,mediation forms,team construction,and other aspects,and identifying the difficulties and obstacles in the operation of the current mediation mechanism from the problems;The fifth part is the countermeasures and suggestions for improving the mediation mechanism.Based on the analyzed problems,feasible and innovative suggestions for improving the mediation mechanism are proposed from the perspectives of conceptual innovation,institutional construction,model innovation,and security strengthening,in order to further enhance the modernization of the social governance system and capabilities. |
