Research On Relatively Centralized Power Of Administrative Penalty

The system of relatively centralized administrative punishment is a major innovation in the process of establishing a socialist legal system with Chinese characteristics in China.In the modern society where administrative punishment is the main means of state management,it is very important to improve and develop this new system.Due to the late implementation of the relatively centralized administrative punishment system in China,there are currently some problems in the operation of this system,such as the overlapping of administrative enforcement powers,the extension of enforcement powers,and the low efficiency of enforcement.Although Article 18 of the Law on Administrative Punishment of 2021 amended the provisions of the relatively centralized administrative punishment system,in practice,the relatively centralized system still exists.The specific problems related to administrative punishment mentioned above still exist.In order to further clarify the purpose and scope of this power and regulate the enforcement methods and procedures of punitive administrative power,this thesis firstly elaborates the concept and theoretical basis of relatively centralized punitive administrative power through literature research,interviews,surveys and comparative analysis.The history and effects of the practice of centralized relative punitive administrative power system in China are introduced.Then the problems encountered in the implementation of the centralized relative administrative power system are organized and analyzed.In response to these specific problems,after clarifying the intrinsic causes,the legal basis of the relative centralized administrative penalty power is improved,the main body of administrative law enforcement and the scope of law enforcement are clarified,the financial,human and technical guarantees of the relative centralized administrative penalty power are strengthened,the quality and law enforcement ability of administrative law enforcement officers are improved,and the relative centralized administrative penalty power is strengthened.It is recommended to standardize the law enforcement procedures of this power.The solution is to clarify the enforcement of the relatively centralized administrative penalty power,coordinate the work of the law enforcement organs with other administrative organs,and provide some suggestions for better implementation of the power through other specific strategies.The purpose is to provide suggestions for better implementation of the relatively centralized administrative penalty authority and to solve the problems encountered in the process of implementing the relatively centralized administrative penalty authority.
