| The Marrakesh Treaty is the first international treaty to restrict copyright.Its purpose is to meet the basic cultural needs of dyslexics,provide them with more reading opportunities,access to information resources,and improve their comprehensive quality,which is especially important for dyslexics in underdeveloped regions and countries.Article 24,Paragraph 12,Clause 1 of the Copyright Law,which was published in November 2020,made a major adjustment to dyslexia,changing published Braille works to ones that can be perceived by dyslexics.The amendment of this article has expanded the scope of accessible works,the scope of beneficiaries and the limitation of rights,providing a legal basis for the ratification and implementation of the Marrakesh Treaty in China.Although the legislative amendments made by the Copyright Law to dyslexia benefit more people with dyslexia and become their good news,there are also deficiencies in legislation and practical application.In terms of legislation,the concept of "authorized entity",the scope of rights and obligations,the scope of "beneficiary subject",the lack of identification standards and the lack of relevant provisions on barrier-free works make the fair use of copyright for dyslexia prominent.In practice,the reading of dyslexics usually needs the assistance of barrier-free format edition.However,the barrier-free format edition has some problems such as high production cost,complicated production process and limited production quantity,which is not conducive to reading of dyslexics.In this context,combining with the Treaty of Marrakesh and the legislation and practical application of dyslexia in other countries,this paper analyzes the rational use of copyright of dyslexia in our country,improves the legislation and implementation mechanism of reasonable use of copyright of handicap accessibility,and makes clear the scope,beneficiary subjects and authorized entities of barrier-free format version.And with the help of cross-border exchange to ease the difficulty of barrier-free reading. |
