In recent years,under China’s policy of cracking down drug-related crimes,smuggling,trafficking,transportation and manufacturing of drug-related crimes have been curbed to a certain extent,but with the continuous changes in the world’s political,economic,social and other fields and the rise and development of the Internet,the drug trade on the Internet has become increasingly active,and the situation of domestic drug trafficking crimes has emerged new situations and changes.Therefore,there is an urgent need for effective governance of online drug trafficking crimes.Understanding the characteristics of the current network drug trafficking crime and discovering the difficulties in the governance process of network drug trafficking crimes are the only way to deal with the online drug trafficking crimes in China.At the present,in terms of the characteristics of the criminal subject,many criminals have criminal records;Most of them are locals;Mainly committed alone,there are many joint crimes;Most criminals are familiar with the drug crime knowledge of county officials.In terms of the characteristics of criminal behavior,criminal behavior is more covert;Most of the crimes were committed in a wide area;Logistics delivery of drugs has become a new trend;The delivery of toxic funds is more towards virtualization and digitization.Through research and analysis,there are three main difficulties and challenges encountered in the process of cracking down on online drug trafficking crimes: firstly,new challenges are encountered in investigation and evidence collection,specifically manifested in difficulties in case discovery and identification of offenders,difficulties in obtaining and fixing electronic evidence,and difficulties in investigation cooperation;Secondly,there are new challenges in the application of the law,specifically manifested in the issues of accomplished crimes,accomplices,and identification of drug attributes in online drug trafficking crimes;Thirdly,comprehensive social governance has encountered new difficulties,specifically manifested in the lack of daily supervision of the internet,loopholes in the management system of e-commerce platforms,the convenience provided by virtual digital currencies for online drug trafficking crimes,and the ease with which the shipping industry provides cover for online drug trafficking.At present,some countries have introduced relatively perfect legal provisions and supporting systems.According to the causes of the crime of network drug trafficking and the experience of foreign governance,the governance measures for the crime of network drug trafficking can start from two aspects: first,use information technology to investigate and build a professional investigation team;Second,strengthen the legislative improvement of criminal governance of drug trafficking through the Internet;Third,the whole society needs to coordinate its efforts to build a drug control system.
