We Chat business,as a new e-commerce model,is different from the traditional material-centered e-commerce marketing model,which is prominently human-centered and relies on social relationships for sales.However,due to the lack of legal regulation and imperfect ideas of dispute resolution in practice,it is difficult to effectively protect consumers’ rights and interests such as the right to know the truth,the right to fair trade,and the right to safety and security in actual transactions.Based on the basic premise of protecting consumers’ rights and interests,exploring the ways and measures to protect consumers’ legitimate rights and interests under the We Chat business transaction model in China,with a view to achieving both the orderly operation of the We Chat business transaction model and the effective protection of consumers’ legitimate rights and interests.Starting from the conceptual definition and transaction characteristics of We Chat business transaction model,analyzing the multi-party legal relationship between the transaction subjects.The right of consumers to know the truth,the right to fair trade,and the right to safety and security are analyzed,and the specific manifestations of infringement of consumers’ legitimate rights and interests by operators under We Chat business transactions are pointed out.We analyze the current situation and shortcomings of the regulation of consumer rights and interests under China’s We Chat business transaction model from four aspects: legal regulation,law enforcement and supervision,judicial cases,and industry rules,and conclude that the content of China’s legislation can hardly respond to the needs of consumer rights and interests protection,law enforcement and supervision can hardly fill the regulatory gap in the field of We Chat business transaction,judicial remedy mechanism can hardly provide reasonable guidance for practical dispute resolution,and the industry rules system of We Chat business transaction has functional omissions.On the basis of overseas experience,we propose the following recommendations for the protection of consumers’ rights and interests under the We Chat business transaction model in China: to improve the legislative protection of consumers’ rights and interests under the We Chat business transaction model,including: improving the registration standards for We Chat business transaction operators and clarifying the registration requirements for We Chat business transaction operators;to strengthen the law enforcement supervision for the protection of consumers’ rights and interests under the We Chat business transaction model,including: promoting online registration and permission system,and strengthening the supervision between platforms.The legal remedies for the protection of consumers’ rights and interests under the We Chat business transaction model include: improving the criteria for determining the "fraud" of We Chat business transaction operators and clarifying the mode of attribution of responsibility for the negligence of We Chat business transaction platforms;constructing and improving the industry self-regulatory mechanism for the protection of consumers’ rights and interests under the We Chat business transaction model,including.The construction and improvement of the industry self-regulatory mechanism for consumer rights and interests protection under the We Chat business transaction model,including: the construction of a credit evaluation mechanism for transaction and the improvement of the online dispute resolution mechanism.
