| The booming development of the Internet in China has not only brought great impact to Chinese society,but also met the people’s need for a better life.With the rapid development of the Internet,new types of civil disputes are also showing a surge trend.Traditional dispute settlement methods are inadequate to deal with online disputes,and the shortage of judicial resources is still increasing.The online mediation mechanism keeps up with the trend of The Times and combines the traditional mediation system with the advantages of Internet technology.It is an efficient and convenient dispute resolution mechanism.The essence of online mediation is the same as that of traditional mediation.Both resolve disputes between parties through consultation,which conforms to the concept that peace is the most valuable since ancient times.In addition,online mediation breaks through the disadvantages of traditional mediation and solves disputes in a low confrontational and low-cost way,so as to solve disputes effectively.As an important part of online dispute resolution mechanism,online mediation mechanism has begun to take shape after more than 20 years of active exploration.The system,rules and scope of application related to online mediation mechanism are relatively perfect,but there are still some problems in practice.The main problems are as follows: First,the development of Internet technology is unbalanced.Second,the online mediation procedure is not perfect.Third,there are obstacles to the confirmation and implementation of online mediation agreements.In view of these problems,the author puts forward some feasible solutions,such as strengthening the support of Internet technology to the online mediation mechanism,clarifying the way of electronic service and perfecting the implementation measures of the online mediation agreement,etc.,so as to provide valuable solutions for the development of the online mediation mechanism of our country. |
