Study Of The Coercive Enforcement Of Housing Fund

Can the housing fund be enforced or not? And how to enforce it? As to the above questions,there are significant differences in both theoretical circle and judicial practice.Some courts incorporate housing fund into the scope of subject matter of enforcement directly.However,the enforcement of housing fund has become a difficult problem that should be solved quickly in practice.In assisting the compulsory disposing measures taken for deducting or withdrawing,the Housing Fund Management Center requires that the court provide the evidence or relevant materials for proving that the person against whom a judgment is being enforced complies with the terms of deduct and withdrawal.Otherwise,it refuses to assist and support the court.During the period in which husband and wife are under contract of marriage,the housing fund of the person against whom a judgment is being enforced or his/her spouse can be enforced or not? And how to enforce? The new problems and new situations,like the above,have always led to the opposition to enforcement.In this thesis,the author analyzes the cases concerning opposition to enforcing housing fund,summarizes the focus of controversy and practical dilemma in the coercive enforcement of housing fund in our country by combining the nature of housing fund.In addition,by taking the making up of the Civil Law of Coercive Enforcement as an opportunity,she defines the legal basis and regulations for the coercive enforcement of housing fund,unifies the routes of judicial judgment.Then,she puts forward some suggestions for improving the principle,conditions,and supporting system of enforcement to solve the difficulties in coercive enforcement of housing fund and to realize the unity of both legal effect and social effect in enforcing housing fund.
