Research On The Implementation Effect Of Procuratorial Suggestions In Hubei Province Suicounty

Procuratorial proposals of social governance is the main path for procuratorial organs to fully perform their legal supervision duties and carry out social governance in a way other than judicial handling of cases.It is also an important practical exploration for procuratorial organs to promote the modernization of national governance system and governance capacity from the perspective of justice.The demand of all sectors of society for procuratorial organs to prevent the risk of illegal and criminal activities and punish illegal and criminal activities is not limited to the handling of individual cases.In 2019,after ten years of trial implementation and accumulation,the Supreme People’s Procuratorate perfected and formulated the provisions on procuratorial recommendations of the people’s Procuratorate.It marks that the standardization,legalization and institutionalization of the procuratorial proposals of social governance have reached a new level.However,in practice,the social governance effect of procuratorial organs is not ideal,and there is great room for improvement and potential.This paper takes the implementation effect of the procuratorial proposals of social governance in suixian County,Hubei Province as the research background.Firstly,based on combing the conceptual nature,development process and theoretical support of social governance procuratorial recommendations,this paper discusses the connotation and main functions of the procuratorial proposals of social governance.Secondly,combined with the problems arising from the implementation of suixian Procuratorate in Hubei Province and several typical cases of the procuratorial proposals of social governance nationwide,this paper uses case analysis,empirical analysis,literature reading and other research methods to analyze.It is found that the main problems in its implementation are reflected in the lack of standardization,pertinence and materiality of the procuratorial proposals of social governance issued,the insufficient binding force of the procuratorial proposals of social governance on the proposed object,the imperfect internal operation mechanism of the procuratorial organ and the insufficient interaction between the procuratorial organ and the outside world.Finally,in view of the related problems,this paper puts forward some targeted solutions and personal ideas to improve the relevant systems.It is hoped that this article can provide a feasible reference for procuratorial organs to give full play to the function of social governance in the performance of legal supervision,highlight the important position of social governance in procuratorial work,change the working concept of procuratorial organs that attach importance to judicial cases and ignore the effect of social governance,promote the comprehensive,balanced and balanced development of procuratorial work,and finally realize the actual effect of mutual promotion between the effect of rule of law and social effect,Strive to contribute more important procuratorial forces to the modernization of the national governance system and the development of the national rule of law.
