With the advancement of China’s rural land system reform in recent years,the system of agricultural land and construction land has tended to be improved,but the system of rural homestead allocation and circulation still has significant shortcomings.Due to the continuous increase in rural population mobility and the decrease in the number of resident villagers,the number of idle residential land is large and the utilization rate is low;At the same time,the rural homestead transfer market is not standardized,and there are frequent cases of hidden transactions.The lack of a unified transfer income distribution system not only makes it difficult for farmers to fully obtain the property rights and interests of the value-added income from homestead,but also is not conducive to attracting new agricultural business entities to return home for entrepreneurship and industrial and commercial capital investment.Therefore,based on a systematic review of the "three rights split" reform pilot projects for rural homestead in recent years,this article comprehensively applies property rights theory,urban-rural integration development theory to specifically explore the issues of unclear division of ownership,qualification,and use rights in the "three rights split" reform of homestead,limited market demand for rural homestead,and insufficient credit for investment and financing of homestead rights,And the imperfect "three rights separation" system for rural homestead,the imperfect market for homestead transfer,and the unreasonable distribution of transfer proceeds.In addition,from clarifying the public property attribute of rural homestead ownership,improving the recognition and distribution mechanism of rural homestead qualification rights,and standardizing the rights and powers of rural homestead use rights,And put forward specific countermeasures and suggestions on the construction of rural homestead property rights market investment and financing and risk prevention and control mechanisms.
