Land, the foundation of life, is the most basic elements of social productivity. La nd system is a vital important problem which is unable to avoid during China’s econo mic and social development. The land property system is one of the most basic guaran tees of rural residents, which protects the basic dwelling rights of them. However, alon g with China’s accelerating urbanization, the current rural homestead property right syst em is unable to work with urban and rural overall development, which needs to perfec t the reform. The fundamental realities of China cause that many problems, such as di spersion of homestead lands and low efficiency of land resource using, which can only be adjusted through a variety of methods to improve utilization efficiency of homeste ad lands. The reform of rural land property rights system is the inevitable choice of ra pid urbanization. Due to the current dual household registration system and the dual la nd system, which effect rural areas for a long time, will severely hinder the connectio n between the urban areas and rural areas, which makes the speed of urban and rural overall development slower. Therefore, the reform of rural land property right system b ecomes a core innovation that will promote the urban-rural integration development. M ore importantly, the land property right system as one of the most basic security syste ms, will balance development between urban and rural areas, remit the pressure of the rural residents, which plays a significant role to promote social justice.The first part is introduction which introduces the background, research status at h ome and abroad and the purpose of this research. The second part expounds the prese nt situation of the rural land property right system in the process of our urbanization, respectively describes from the development process, present situation and the necessity and urgency of reform of rural homestead property right system. The third part is ab out the problems happened during the homestead registration, approval process, circulati on of right of use, and house acquisition process. After this, this article reveals the re asons of those problems above through idea, system and practice.According to the conclusions above, the author respectively proposes various sugge stions as follows:first, government should clarify homestead property right and state th e subject of it in the process of registration. Second, the rural collective economic org anizations should lead the rural residents to explore for a compensational, terminable s ystem of homestead. Third, the various functional departments should speed up the est ablishment and perfect the homestead conditional exit mechanism, active the intermedia ry service, perfect the homestead circulation. Fourth, the legislature shall establish and perfect the relevant supporting system, guarantee the order of homestead circulation. Fi fth, government should carry out the demonstration village strategy, also promote the c onstruction of homestead primary market and give farmers publicity in daily life to im prove their advanced consciousness.
