| The development of digital economy and information age leads to individuals producing data all the time.Social development and enterprise progress urgently need to explore the value contained in personal data.At the same time,as the main body of data generation,individuals are"marginalized" in relevant links,and their rights and interests cannot be guaranteed.Therefore,strengthening the protection of personal data,optimizing the circulation and reuse of personal data become the core objectives of further development of the digital economy,and are also opportunities and challenges facing the times.The Personal Information Protection Law of 2021 stipulates the relevant content of "personal information portability" for the first time.It not only strengthens the individual’s control over the transfer and reuse of personal data,but also puts forward new requirements for corporate data compliance.It reflects the legislative thinking of returning personal information rights to individuals,and provides new opportunities and directions for the flow and aggregation of personal data.And it brings new approaches to the development of the personal data factor market from the underlying logic.This study firstly summarizes related concepts of personal data,and clarifies that the scope of personal data in value marketization includes personal data and observed data in a narrow sense,excluding derived data.Secondly,the structural equation model is used to clarify the data subject’s demand and willingness to accept the personal data circulation market in the form of questionnaire survey,and the value of personal data is analyzed and the defects of the current exploration projects at home and abroad seeking new paradigm and the current traditional model exist.This paper expounds that the construction of the industrial chain of marketization of the value of personal data requires that the development and utilization of personal data should always take into account the openness,privacy and security,and fully protect the corresponding rights and interests of data subjects.Then,on the basis of the above,a marketization industry chain of personal data value,which is the core of this study,is established to introduce personal data operators as the intermediary,personal data operators and the government as the leading role,data fiduciary as the theoretical support,blockchain as the technical support,and government and alliance committee as the supervision.Personal data subject,data controller,data operator and data demand-side are the multilateral market model of personal data value marketization,and the positioning,rights and obligations of each market subject are expounded respectively.Finally,an effective and feasible operation guarantee mechanism and incentive mechanism are designed for the constructed industrial chain model:Right protection mechanism,cooperation and trust mechanism,information exchange and coordination mechanism and interest distribution mechanism.It is proposed that industrial incentive mechanism should start from multiple levels(micro level,middle level,macro level)and multiple levels(value co-creation subject level,decision-making management level,technical support level)to form endogenous and exogenous dual optimization incentive. |
